Dear Highland NHS Board,

1. Could your organization please provide a detailed breakdown of all the charges and rental charges applied in every premises of the Staff Accommodation Department of Raigmore Hospital in the current Financial Year 2018-2019?

2. Could your organization please provide copies of all the documents that should be made available to residents (i.e. there should still be no need to ask for them) as mentioned by your partner Highland Council in its new and reworded H.M.O. Licence Conditions and H.M.O. Standards, including copies of all the documents and certificates that should still be retained for at least three years?

The above is an annotation that your organization has recently started introducing in some of the job positions that are being advertised.

3. How about being married or in a civil partnership; being pregnant or on maternity; being or becoming a transsexual person; being of a different religion, belief or lack of religion/belief? Are job applications from those types of people currently welcome in your organization?

Your organization said that any profits made from the Staff Accommodation Department are reinvested to upgrade and maintain the accommodation. It is a real struggle to see where the large profits made from those premises are being reinvested.

4. Could your organization please provide a detailed breakdown of how and where the many millions of pounds profits made in recent years from the Staff Accommodation Department have been reinvested? (For example, in a FoI request I submitted some time ago it appeared that from the premises where I live - that is just one of the dozens of premises that make up the Staff Accommodation Department - your organization made a profit of only £78,974. The actual profit made from that premises must have been a lot higher than £78,974 as the actual rental charges applied by your organization at that time were a lot higher than what it had claimed in its FoI response.)

Your organization said that its relationship with the NHS staff living in the Staff Accommodation Department is landlord/tenant rather than employer/employee.

5. When was this new internal policy introduced?

6. Are this newly introduced internal policy and the minutes of the meetings that brought your organization to the decision of modifying the previous internal policy available? Can your organization please provide copies of its newly introduced internal policy and of the minutes?

Please let me know if your organization wishes me to expand on the introduction to Q5 and Q6. I will try to do my best.

I often witness one of your members of staff (it was the same member of staff to which your organization assigned the “investigation” of my Formal Complaint, and that I mentioned in some of my previous FoI requests, https://www.whatdotheyknow.com/request/u..., https://www.whatdotheyknow.com/request/u..., and that led your organization being taken to the Sheriff Court not once but twice) going around the Staff Accommodation Department, on her own, to collect money from coin-operated equipment.

7. Could your organization please say what systems it has in place to ensure that the money collected by your member of staff matches the money banked?

The same member of staff was also seen tampering, on purpose, with fire equipment within a premise of the Staff Accommodation Department.

8. Could your organization please say what the current legislation and fire safety regulations, and also your internal policies, say regarding tampering with fire equipment?

9. Could your organization please say what the legal consequences for tampering with fire equipment are?

10. Could your organization please say who would be held legally liable in case of an incident in a premises where fire equipment has been intentionally tampered with?

11. Could your organization please confirm on which types of people it is always making sure of strictly applying its internal policies?

An answer to Q11 might help us to understand the criteria that your organization identifies when it deals with people.

12. Could your organization please say who, when and why my Study Room was accessed in recent times and what it was that those people were planning to do or looking for? (In one of those occasions I didn’t even manage to see who they were. They immediately run off when they realized that I was actually in that day.)

I am writing to request an internal review of Highland NHS Board's handling of my FOI request 'Raigmore Hospital Staff Accommodation 19'.

Could your organization please provide copies of the documents requested in Q2?

As mentioned in its new and reworded H.M.O. Licence Conditions recently issued by your partner Highland Council, those documents must be made available to the occupiers within the premises where they can be conveniently read by residents. Even its HMO RENEWAL/INTERIM INSPECTION FORM clearly states that documentation is to be displayed within the premises and must be clearly displayed. This means that there should still be no need to ask to see those documents. There should still be no need to look for those documents. And there should certainly be no need to follow your office hours in order to see those documents.

It is years that I am asking to see those documents from your organization, and being asking your partner Highland Council to help me obtaining those documents – this all happened well before your partner Highland Council decided to renew its H.M.O. Licence Conditions and H.M.O. Standards. Those documents would appear to be a legal requirement for running HMOs. If your organization holds those documents, would it please make them available?

Could your organization please provide the financial information requested in Q4?

It is still a real struggle to see in which premises the many millions of pounds made in recent years by your organization from the Staff Accommodation Department at Raigmore (the small premises adjacent to the main premises. The Hospital) have actually been reinvested.

Could your organization please provide the information requested in Q12?

The new and reworded H.M.O. Standards recently introduced by your partner Highland Council is still clearly stating that who accesses a tenant’s room for any reason without the tenant’s consent must be accompanied by a witness and must record the reason, action and outcome of the entry.

If your organization holds records of who, when and why my Study Room was accessed in recent times and what it was that those people were planning to do or looking for (in one of those occasions I didn’t even manage to see who they were. They immediately run off when they realized that I was actually in that day), could it please provide those records?
