could you please clarify what you mean by 'crimes linked to racist or
religious discrimination'? Do you mean crimes with a race and religious
hate element, or do you mean something else?

Many thanks for your quick reply.

Yes, I meant crimes related to race or religious hatred.

The documents provided are useful, and I would like to see if this could be provided by month, and also whether you had specific data regarding Islamophobia.

I would like to compare comparable periods, and since 2015 is not yet finished the data provided in the last FOI does not help me break it down.

I note that in the Home Office hate crimes report (mentioned earlier) they give national statistics by month, which I assumed are compiled from police data by each region.

Provision of information held by Northumbria Police made under the Freedom
of Information Act 2000 (the 'Act')

Thank you for your e mail dated 23 November 2015 in which you made a
request for access to certain information which may be held by Northumbria
Police.

As you may be aware the purpose of the Act is to allow a general right of
access to information held at the time of a request, by a Public Authority
(including the Police), subject to certain limitations and exemptions.
 
You asked:
Could you please provide the number of crimes with a race or religious
hate element over the last 10 years (or for as far as such statistics
exist), broken down by month, with separate figures for Islamophobic
crimes?

We have now had the opportunity to fully consider your request and I
provide a response for your attention.

Information Commissioners Office (ICO) guidelines state that:
A public authority must confirm or deny whether it holds the information
requested unless the cost of this alone would exceed the appropriate
limit.  I can neither confirm nor deny than the information you require is
held by Northumbria Police as to actually determine if it is held would
exceed the permitted 18 hours therefore Section 12 (2) of the Freedom of
Information Act would apply.  This section does not oblige a public
authority to comply with a request for information if the authority
estimated that the cost of complying with the request would exceed the
appropriate limit of 18 hours, equating to £450.00

You should consider this to be a refusal notice under Section 17 of the
Act for  your request.
I have set out the reasons for this below.
There is no specific flag or marker for Islamophobic crime.  Our crime
recording system has faith or religious flags but nothing more specific.
Between 2008 and 30th June 2015 there were 5324 hate crimes with a faith
or religious flag.  To attempt to establish if a crime with a faith or
religious flag related to Islamophobia would entail a manual review of
each crime, and potentially the incident linked to that crime.  Even at a
  conservative estimate of 3 minutes per record, which we have considered
as reasonable, we have estimated that, if held, to extract this
information, would take over 266 hours, therefore Section 12 of the
Freedom of Information Act applies.

When applying Section 12 exemption our duty to assist under Section 16 of
the Act would normally entail that we contact you to determine whether it
is possible to refine the scope of your request to bring it within the
cost limits.  However, from the information we have outlined above I see
no reasonable way in which we can do so, even for a considerably shorter
time period.

In an effort to aid and assist I can advise that information on this
subject area has been asked for previously, released and published on the
Northumbria Police Disclosure Log.

Due to the different methods of recording information across 43 forces, a
specific response from one constabulary should not be seen as an
indication of what information could be supplied (within cost) by another.
 Systems used for recording these figures are not generic, nor are the
procedures used locally in capturing the data.  For this reason responses
between forces may differ, and should not be used for comparative
purposes.

You may be interested to know that Northumbria Police routinely publish
information via the Disclosure Log.  The aim of the Disclosure Log is to
promote openness and transparency by voluntarily placing information into
the public arena.

The Disclosure Log contains copies of some of the information that has
been disclosed by Northumbria Police in response to requests made under
the Freedom of Information Act 2000.

Whilst it is not possible to publish all responses we will endeavour to
publish those where we feel that the information disclosed is in the wider
public interest.

The Disclosure Log will be updated once responses have been sent to the
requester.
