Please provide a list of all racist attacks recorded in the different areas of the West Midlands between 1990 and 2017.

Please provide them according to the ethnicity of the victim(s) and perpetrator(s), e.g. white on Asian, black on white, Asian on black etc.

I am writing to ask you to clarify your request. This is because we need further details from you in order to identify and locate the information.

Therefore I should be grateful if you would clarify what you mean by ‘attack’? Do you mean assault only or would this include all racial crime including words only, which would include racially aggravated offences?

Please contact me if you need assistance with this.

To enable us to proceed with your request I would be grateful if you could provide the clarification outlined above. After receiving your reply, your request will be considered and you will receive a response within the statutory timescale of 20 working days, as defined by the Act, subject to the application of any statutory exemptions. CLARIFICATION

 

I mean a physical assault only.

 

RESPONSE

 

Our data are not organised in such a way as to allow us to provide this
information within the appropriate (cost) limit within the Freedom of
Information (FOI) Act (see ‘Reason for Decision’ below).

 

However rather than refusing your request outright at this stage, I would
like to explore with you how West Midlands Police may best assist you to
request relevant information which we hold. Within the cost limit we could
conduct search for racially aggravated offences and violence with
injury since 2002, broken down by victim and defendant self-defined
ethnicity where recorded.

Please note that any located information might be subject to the
application of exemptions under the Act.

 

To enable us to proceed with your request I would be grateful if you could
confirm whether you wish us to provide the information outlined above.
After receiving your reply, your request will be considered and you will
receive a response within the statutory timescale of 20 working days, as
defined by the Act, subject to the application of any statutory
exemptions. If you chose not to respond then your request will remain
unanswered.

 

REASON FOR DECISION

 

Please note that researching each individual case would exceed the
appropriate limit (FOIA, s.12).

 

The cost of compliance with the whole of your request is above the amount
to which we are legally required to respond, i.e. the cost of locating and
retrieving the information would exceed the appropriate costs limit under
section 12(1) of the FOI Act 2000. For West Midlands Police, the
appropriate limit is set at £450, as prescribed by the Freedom of
Information and Data Protection (Appropriate Limit and Fees) Regulations
2004, S.I. 3244.
