Dear Department for Work and Pensions,

(1) Please provide the full text of the articles with the following titles published on the DWP intranet site written by [name removed] (Race Action Lead within the DWP):

(i) "Your black colleagues are most probably not okay right now"

(ii) "Time to get uncomfortable; Let's talk about Racism."

(iii) "What Black History Month Means To Me"

(2) If any of the articles listed in request (1) have been altered since they were originally published on the DWP intranet site, then in addition to request (1), please also provide:

(i) any previous versions of the same articles
(ii) the date that the article was changed
(iii) the reason that the article was changed

(3) Please provide any documentation held by the DWP which exempts [name removed] from acting in accordance with the requirements of the Civil Service Code.

Dear Isaac Roberts,

Thank you for your Freedom of Information (FoI) request received on 2 July
2023. You wrote:

DWP Response

We can confirm that we hold information falling within the terms of your
request; however, we need more time to consider aspects of your request.

We are writing to advise you that the following exemption applies to the
information that you have requested:

Section 38 - Health and safety

Section 10(3) of the FoI Act provides that, where public authorities have
to consider the balance of the public interest in relation to a request,
they do not have to comply with the request until such a time as is
reasonable in the circumstances.

We have not yet reached a decision on the balance of the public interest.
We need to consider all the circumstances of the case, to determine where
the balance of the public interest lies in relation to the information
that you have requested. Therefore, we will not be able to respond to your
request in full within 20 working days of the initial receipt of your
request.

We are therefore aiming to let you have a full response by 30 August 2023.

Please note we have redacted the name of the person mentioned within the
body of your FoI request as it constitutes personal data of someone other
than yourself and as such, it is being withheld in accordance with section
40(2) of the Freedom of Information Act.

Section 40(2) exempts information if it is personal data belonging to an
individual other than the requester and it satisfies one of the conditions
listed in the legislation. In this case the condition contained in section
40(3A)(a) applies - that disclosure would breach one of the data
protection principles, specifically that "Personal data shall be processed
lawfully, fairly and in a transparent manner...".

We do not consider that disclosing this information is necessary or
justified in order to satisfy your information request and the
requirements of the FoI Act. In relation to this request, we consider that
there is no strong legitimate interest that would override the prejudice
to the rights and freedoms of the data subject.

Personal data are subject to General Data Protection Regulation (GDPR) and
the Data Protection Act 2018.

It is also confirmed in the attached letter.
