To clarify my request for the decision: I am requesting the reasons for HM Courts and Tribunals' decision to allow an application to the Upper Tribunal even though it was out of time and not the Upper Tribunal decision itself.

Hi Ken,

On page 2 of the FTC3 form the applicant gave reasons for the application being submitted out of time. The Pensions Regulator also had sight of this application and noted the same, who then asked to strike out the application. The judge, having seen the application and the request for strike out, asked for the case to be listed for a hearing, the outcome of which is in the decision I e-mailed to you.
