Questions about the monitoring of Essex Police's investigation and reviews into the death of Lee Balkwell.

Please supply the following information:

1. On what dates if any has the Essex Police and Crime Commissioner (EPCC) (or its predecessor body the Essex Police Authority) (EPA) (or many of their respective sub-committees) received reports (verbal or in writing) from Essex Police about the investigation and reviews into the death of Lee Balkwell on 18 July 2002?

2. Of these, which reports were verbal and which were in writing?

3. On each occasion, which Essex Police officer attended to present those reports?

4. What action has either body (EPCC or EPA) taken in response to the widespread concern about the handling of this case, and specifically what action did either body take following the damning IPCC report of 29 June 2009 which slated Essex Police's initial investigation into Lee's death as 'seriously flawed' and what action did it take following the IPCC's further report dated 29 January 2012 which found 8 Essex Police officers (most of them senior) guilty of 26 separate instances of misconduct?

Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties on public authorities. Unless exemptions apply, the first duty under S1(1)(a) is to confirm or deny whether the information specified in the request is held. The second duty at S1(1)(b) is to disclose the information that has been confirmed as being held.

I have considered your request for information and respond as follows.

This part of my response in accordance with Section 17 of the Freedom of Information Act serves as a formal refusal of your request on the grounds that the exemptions at S31(b) and (c) (Law Enforcement) apply.

S31 (b) and (c) To clarify, this matter is still subject to a current investigation and release of the information would interfere with the investigation and the administration of justice.

I trust this information satisfies your request. If you are dissatisfied with the handling of your request you have the right to ask for an internal review which should be addressed to the Executive Director, Office of the Police and Crime Commissioner for Essex, 3 Hoffmanns Way, Chelmsford, Essex CM1 1GU.
