I understand there has been a Wiltshire investigation about data quality being produced by a number of agencies in Wiltshire, including your own. As you know I am aware of significant and serious issues and failings relating to the recording systems used, the accuracy of the data you are processing,the completeness of the data you are processing,and your compliance with the many specific requirements of the Data Protection Act and the additional duties placed upon you by the NHS - which ive found are often ignored and consequently ive found you are not compliant with the requirements placed upon you.
I have read on your website " The Trusts existing Information Management and Data Quality Strategy has yielded positive outcomes against some measures of data quality, however in light of recent events, it is recognised that more work is required to provide further and more comprehensive assurance " It would appear from this statement that the Board do not wholly trust the statistics and information being provided by staff when preparing such reports and statistics - is that the case ? I would also like to see the information you hold that supports the statement made by a Board member " however in light of recent events " as these would appear to suggest questionable data processing and handling quality - will you please supply me with the information that supports this statement ? Will you please supply me with the current Management and Data Quality Strategy, and the revision that is now proposed for 2012 - 2013. I also read, " This report has been drafted in light of the Wiltshire Investigation about data quality " please supply me with a copy of the report being described here. It continues " The report has been re drafted and points to the reporting requirements " may I also have a copy of the re drafted report please. I also read about your own benchmarking figures " We need to question this given the issues that Wiltshire has raised for us " = can I please see the issues 'Wiltshire' raised for you - along with the full report in which they raised iit. Which organisations and who in Wiltshire were involved in preparing and writing the reports ? In light of the MANY SSERIOUS ISSUEs I HAVE RAISED WITH YOUR TRUST REGARDING SERIOUS DATA PROTECTION AND PROCESSING ISSUES, I am pleased you are FINALLY looking at these issues.

I have received your email of todays date without any difficulty, and am disappointed to note that for a second time now in recent weeks, you claim not to have received my emailed FOI request via the whatdotheyknow website - TWICE IN JUST A FEW WEEKS ?? Whatdotheyknow
are an excellent website, when an email FOI request is bounced back undelivered they notify the requestor. I ask you to carry out an investigation to identify the problem that appears to solely exist with your organisation, maybe your board have instructed you to delete any 'sensitive' FOI request I make until after your board have discussed it at the end of the month, or maybe a member of staff or yourself are looking to decrease their workload, maybe you or someone else are deliberately spreading their workload in this way so as to make themselves look good and meet targets ? Who knows, I would believe anything of your trust both from my experiences with you, and the huge amount of critical press you have attracted over so many years. I understand there is a permanent record on computers of emails received, and I ask you to check to see if someone has deleted it as there will certainly be a record. Clearly Whatdotheyknow can easily check if it was received by you, but I do not wish to inconvenience them as they are not at fault I believe ? I look forward to proper, full and hopefully totally honest clarification of this matter, I shall now re submit my request, in the hope you will deal with it within 20 working days of the date of the original request that was sent to you ?

Thank you for your email of todays date, which I have reason to believe AGAIN contains incorrect information. As you know, whatdotheyknow is an excellent website, so much so that within SECONDS of my emailing you here yesterday, I received an email from them that would appear to clarify the TRUE position.
The message from them states : the message sent on 24th September WAS DELIVERED to the NHS email server - mail.nhs.uk and an OK message was sent back, confirming the message was being 'queued' and issued the reference number A5E77448850. I ask you, in light of this firm and true information held on their computers, that you will now explain the TRUE position? Trying to get an acceptable level of service and the whole truth out of AWP could be compared to getting blood out of a stone?

As this would appear to be yet another 'loss' of my personal data within your organisation,I really would like to receive a proper full honest complete unspun explanation of what happened to my email request ( correspondence ) that I am reliably told WAS delivered to your organisation via a reliable and trusted source.
As this is not the first time in recent weeks that this has happened to my email correspondence within your organisation, information that SHOULD form part of my qualifying data that SHOULD be handled by you in full compliance with DPA & FOI Legislation, I ask you to investigate properly and email me here with your true findings please. Is it deliberate ?? I would ask you to clarify this point also here please : you state " For whatever technical reasons the Trust has not received your request and is therefore unable to process it " and " The Trust is happy to do so if you provide the details of your request ". Have you experienced technical deatils within your trust recently that have resulted in data being lost - if so will you please tell me to what extent and if the ICO has been notified ?1. It would appear the loss of my data ( the problem) exists within your own organisation, and I wish you to establish what actually happened to my request in light of the information I have given you here. 2. You are aware the loss is down to yourselves, have you contacted whatdotheyknow to explain your failure and to ask them to re send it - if so may I please see your contacts with them? 3. I understand under FOI, and indeed other Legislation that applies due to my long term disabilities, you have a duty to assist me and answer questions raised relating to my FOI request - why is this failing to happen. 4. I believe that anyone in the world who has a computer and internet access can easily access and read my request, surely that includes you and your trust ? I have formed the view over many months of dealing with your trust, that you make things as difficult as you can for me, whilst knowing your trust has diagnosed me with two recognised mental health illnesses ( that do not affect my rationalle or ability to identify where I am being subjected to Illegal abuse, hate incidents and hate crime ) and having numerous barriers placed in front of me, whilst remaining untreated for my illnesses due to the unreasonable actions of your trust for 14 MONTHS NOW, so I ask you in light of your trusts claim that you no longer hold the request that you certainly received, why you have not accessed my request yourself from the unique ID contained on the whatdotheyknow emails you are receiving from me, and simply re printed the request and processed it ? Is it the case your trust is deliberately acting in an unreasonable manner, making every effort to delay and prevent my obtaining information I am entitled to see, and quite possibly breaking the Law in the process ? As ive often stated after reading about you in newspapers and on the internet, and indeed experienced, your trust is absolutely awful, and I feel the statements made by your chairman Anthony Gallagher in the press, and indeed the information contained in your Fit for the Future document are false promises in my opinion and from my experience? In light of your trust being responsible for no longer having my request ( and I wonder if that is true? ) are you NOW prepared to download it youself in the manner ive described, and deal with in within the ORIGINAL timescale ? I am in receipt of your email dated 16 10 12, headed " Questionable Data Quality being processed by your Trust, sent to you on 24 09 12 via the Whatdotheyknow website and placed in your NHS queuing system on that date, with an OK message sent back and a reference number of A5E77448B50, and my subsequent email communications with you here. Given the information I have provided you with, I have been invited by the ICO to send in a formal complaint if you have not responded to this request in accordance with your duties to me under the Act on or before 22 10 12, and I therefore FORMALLY NOTIFY YOU this will happen on that date if I do not receive a full and detailed response on or before that date, please send your full response here as a number of other members of the public have contacted me showing interest in my request to you and in the Spirit of FOI I would like them to see your response too - and also provide me with a paper copy please , you have my address. I am writing in response to your correspondence dated 11 and 17 October 2012.

The Trust can confirm again that it did not receive a request from the whatdotheyknow.com website on 24 September 2012.

From the information you have provided, the email was delivered to mail.nhs.uk. This is the national email service for the entire NHS and not Avon and Wiltshire Mental Health Partnership NHS Trust and therefore the request was placed in the national NHS email server queuing system and not the Trust's email servers.

The problem does not exist with the Trust as the Trust did not receive the request.

The Trust has not lost any data, therefore has not informed the Information Commissioner's Office.

The Trust has not contacted whatdotheyknow.com to ask them to resend it, as the Trust is not obliged to do so.

The Trust is aware of it's duties to assist, but believes that there is no assistance it can provide you in resubmitting your request via your personal account created with whatdotheyknow.com.

The Freedom of Information Act states that an organisation must receive a request in order to process it, and the Information Commissioner's Office has confirmed that an organisation is not obliged to retrieve a request.

I am in receipt of your email here dated 19 10 12 and have formed the opinion that I am being given the run around by you - I shall deal with this elsewhere.
On 19 10 12 I travelled to your offices to deliver a photocopy of THIS request shown here on the Whatdotheyknow website that I submitted to you in September as you would not offer me assistance by looking at my request on this website, although you have been emailing this request reference number through there website to argue a number of matters, rather than dealing with the request that was easily
accesible to you via the computer in front of you. You have posted a letter to me dated 06 11 12 in respect of this request, stating you require further clarification and wish me to identify which pages on your own website Ive referred to in my request.I am not very good with computers as you know, Ive already mentioned within my request its titled the Wiltshire Investigation,its in respect of data handling and processing and DPA compliance I Presume ?, your Board of management along with your acting CEO and other staff who regularly attend the Board meetings, and the minute taker would all be aware of this report as it was read and discussed by them at your own Board of Management meeting in recent months and is mentioned and clearly identified within the minutes of that meeting.I trust this will now enable you to speak with any staff member who attends Board meetings each month who SHOULD certainly know how to locate this report, and I ask you to provide your response to my FOI request here please and to also send me a paper copy please. If what you say is true,in light of your position within AWP, I ask why you have not been made aware of the findings of this report or indeed have not been involved in providing evidence for its compilation, raises further concerns ! Some meaningful co operation would not go amiss ! Please acknowledge receipt of this email ASAP.

I have received a duplicate letter from you today in respect of this request.
I have balso received an email from you dated 12 11 12 ( today ). In respect of this request I have responded to you by email as shown on this site on 07 11 12 and 09 11 12 and provided you with the additional guidance youve asked for.Of course if you are experiencing difficulties in receiving my emails, you could offer me resasonable assistance by looking at this FOI request on this site, where you will clearly see my responses to you along with your emails to me, so you obviously know where to read this information. Are you now claiming that you have not received either of those emails as they give clear answers to the questions youve asked ? Maybe if your organisation acknowledged communications from patients in a timely manner it would avoid all the stress and strain, and harm damage and distress that I am starting to feel is being deliberately imposed upon me.
Please acknowledge receipt of all three emails ive mentioned. Is your trust still supposed to ' be putting the patient first ' or is that recent reassurance now long forgotten along with the others ?

I am writing to request an internal review of Avon and Wiltshire Mental Health Partnership NHS Trust's handling of my FOI request 'Questionable Data Quality being processed by your trust'.
As you know, I am disabled with mental health problems, and ask you to make a 'reasonable adjustment' so as to deal with this review request. At AWPs APRIL 2013 meeting of the board, I asked a question regarding data protection issues ive encountered, and the response given by your Hazel Watson was ' .. this was a reference to an issue in Wiltshire, then there had been a concern raised some 12 months age (ago?). A full and thorough investigation had taken place involving both Wiltshire PCT and social services...' this minute was approved by your board o 29 05 13 at a board meeting I attended at Fromeside,Blackberry Hill, Bristol where I asked the Board if this was identified as 'the wiltshire report ' which Mr Tulley - your CEO confirmed it was. I understand this was an in depth investigation, that involved yourself Ms Benfell and also AWPs in house Solicitor and other key staff. I can see from records obtained elsewhere that at the time Wiltshire PCT and Wiltshire Council Social Services destroyed a large number of documents that should have been seen as part of that investigation - hence the WILTSHIRE REPORT I made a number of attempts to access under FOI here ( as documented above ) , found after the mass destruction of documents it appears ' the issue raised had not been found to be accurate. ' although of course there were a significant number of issues I raised . So as to assist you ( maybe you have selective memory loss of your own involvement and that of AWPs solicitor at the time along with other key staff ? ) it is now clearly shown on your own Board minutes of 02 05 13 under Questions from members of the public 3.2 , 3.3 and although I believe you have failed to release this information as you did not want to, clearly a number of people I previously identified DID know about the WILTSHIRE REPORT including your CEO who answered my question at the board meeting today ! I believe it will assist my recovery if AWP can start to be more open and transparent, and ensure they dont in future manipulate or ignore the Law to suit their own hidden agenda? I look forward to a full and detailed response and a copy of the Wiltshire Investigation report please.

Following on from my email above, an Iain Tulley CEO of AWP wrote me another short letter on 04 06 13. It again appears another government body chooses not to provide a report that should have been available under FOI Legislation, this one relating to serious data protection issues within certain agencies in Wiltshire. My request for the report, that is referred to in minutes of their board meetings under the open public section,and I am told contains my qualifying personal data, has been technically refused as Ian Tulley refuses to review my request, despite the lead data protection officer being involved in its compilation.
