Dear Invest Northern Ireland,

Please consider this to be a Freedom of Information request in relation to the Baseline Economic Study of the Music Industry in Northern Ireland commissioned by NIMIC (Northern Ireland Music Industry Commission) in February 2009 which was, according to the terms of reference of the original invitation to tender, to be delivered to NIMIC in final draft form no later than March 27th 2009.

Can you please confirm as follows:

Which mediums / publications were used to advertize this tender?

How many applications were received?

Which bodies, organizations, businesses and individuals tendered for this?

The identity of the individuals involved in the decision / awarding process?

What, if any, changes were made to the contractual terms (time frame, remuneration) of the original invitation to tender after the awarding of the contract?

How many responses to the survey were received?

What methodology / data was used by the surveyors to determine businesses active within the sector?

How many businesses within the sector were approached directly by the surveyors and of those how many completed the survey?

How much money has been paid to the successful party in relation to this tender?

Was the initial deadline of March 27th 2009 for the final draft met / complied with?

What financial penalties, if any, were imposed in the event that the deadline was not met?

Assuming the initial deadline of March 27th was met then what has happened to / has been done with the final draft in the interim given that the decision to wind up NIMIC was not formally arrived at / made public until November of 2009 and the DS01 was not registered with Companies House until 29th March 2010 - a full year after the deadline?

Given the clearly stated intention to have this report made available to the public (Q39 of the questionnaire issued by Dr McCole refers) why, given the protracted timeframe to date, has this report not been made available to interested parties within the sector and wider afield?

Given your assertion that Invest NI provided no funding nor had any input in
relation to the particular tender in question I am surprised that you have
elected to refer me to another of Invest NI's Client Executives.

Can you (Invest NI - previously IDB), in your capacity as one of the
principal funders and the body most closely associated with the failed
Northern Irish Music Industry Commission please provide by return the
contact details of someone who can and will actually supply me with the information I have requested as a matter of public interest?

Am I to assume from same that investni, thoughout the entirety of its
relationship with NIMIC, never managed to establish nor sought to establish
who, if anyone, was responsible for the disbursement and expenditure of
monies which it (investni) or other funding bodies made available to NIMIC
in the normal course of business?

Given this apparent shortcoming can investni itself provide by return
details of all support, financial or otherwise, afforded to NIMIC during the
term of its existence together with details of how investni determined
"value" in respect of any such funding / support and against which
benchmarks any such determinations were arrived at and who was responsible
for the determining of same?

Thank you for your email of 13 January 2011. Please note that the
Northern Ireland Music Industry Commission (NIMIC) was an Invest NI
client company who received funding for specific projects. Invest NI is
responsible only for monitoring the projects which it funds. Invest NI
did not have a governance role over NIMIC.

You have sought information on a Baseline Economic Study of the Music
Industry in Northern Ireland commissioned by NIMIC in February 2009.
Invest NI did not fund this study and as such we hold no records on the
study. Invest NI is not required to keep records of our clients
interactions with other public bodies except to ensure there is no
possibility of duplication of funding.

For administrative purposes the new information you have requested will
be dealt with as another FOI request under separate cover.
