Query about benefits

We're waiting for Shah to read a recent response and update the status.

Dear Home Office,

I have a query about benefits. If two partners are living together as husband and wife, where wife is a British citizen and the husband is subject to immigration control and they have kids together, if the wife is a housewife and the husband is working but on low income and hence the wife is claiming Child tax credit, child benefit, housing benefit and working tax credits on her own or as a joint claim, is the husband who is subject to immigration control breaching the requirements of his visa and will it affect his application for ILR?

Yours faithfully,
Shah

There is a clause what means ctc, cb and wtc ate not public funds. However, if on flr m be aware that you'll need to meet the 18600 income thresholds at renewal

Dear Sir/Madam,

Thank you for your email correspondence of 24 February.

If you have a residence permit that allows you to live in the UK, it may
include the condition that you have no recourse to public funds.  If so,
it means you will not be able to claim most benefits, tax credits or
housing assistance that are paid by the state.

However exemptions do apply in some situations.

Please see the link below for guidance on public funds, please read pages
