I am writing to request an internal review of Department for Transport's handling of my FOI request 'Queensbury Tunnel material'.

Dear Sam,

Thank you for your response dated the 20th April 2020 under reference F0018318 .

The response appears to rely on the wrong statutory provision. Section 14 of the 2000 Act refers to vexatious or repetitive requests. Your response avers that responding would be disproportionately burdensome, so the response is, unfortunately invalid. In any event, there is no intention to be vexatious in any manner whatever. By the nature of a continuing and unfolding situation, several requests for information may be made but they are not repetitive unless the enquirer asks for the same information twice. That has not been done, at least not by me, so section 14 does not apply anyway.

This is therefore a request for an internal review, firstly on the point above, which is unarguable; secondly, I suggest that the importance of receiving the material for the ongoing analysis of the options open for the restoration and re-use of Queensbury Tunnel on the one hand, or its disuse and abandonment on the other, outweigh the additional work (for which I apologize) in dissecting the material (the 152 items) mentioned in your response. I assert that this request is therefore not caught by s.12(1) of the Act. These events happen only infrequently, but do have long-lasting effects and the importance is high. The barrier for invoking section 12 is therefore raised accordingly.

Please proceed to process the request, therefore and I look forward to receipt of the information.
