Dear Sir/Madam

Could you please provide me with a list of all expenditure (fees, costs etc) incurred by the Department for Transport associated with legal action against the landowner at the south end of Queensbury Tunnel (West Yorkshire) since 1st January 2010. Please include the date of each payment, its value and a brief summary as to what the payment covers.

I am writing to request an internal review of the Department for Transport's handling of my FOI request 'Queensbury Tunnel legal fees/costs', your reference F0017356.

In suggesting that disclosure in this case "would place the Department at a commercial disadvantage as disclosure would reduce its ability to negotiate future legal rates and thus reduce its competitiveness in a commercial environment if it is publicly known how much the Department was prepared to pay" suggests that you have inferred a deeper level of expected detail within your response than I actually intended. I was certainly not seeking information that would have enabled specific rates to be estimated.

Could I ask therefore that you simply provide me with a list of dates on which payments relating to legal action/activity against the landowner were made, together with the total value of the payment? You would presumably agree that without some context as to what the payment related to, it would be impossible to draw any meaningful conclusion as to the applicable rates.
