QUALIFICATIONS of MEDICAL/CLINICAL advisers used by the G.M.C

WHEN the G.M.C receive COMPLAINTS FROM PATIENTS regarding a doctor does the G.M.C take advice from EQUIVALENTLY QUALIFIED
MEDICAL / CLINICAL ADVISERS

FOR example WHEN THE COMPLAINT is a about a CONSULTANT RHUEMATOLOGIST does the G.M.C use a CONSULTANT RHUEMATOLOGIST for advice on whether to INVESTIGATE this COMPLAINT.
IF NOT what criteria does the G.M.C use when DECIDING WHO IS QUALIFIED TO MAKE THIS DECISION.

Thank you for your below email seeking information under the Freedom of
Information Act 2000 (FOIA).

 

You asked about whether medically qualified individuals are consulted
about the complaints we receive. The short answer to this would be yes.
The GMC does have medically qualified staff members and external
associates who we rely on for medical opinions. I’ve provided more details
below about some key roles and how we obtain/apply their expertise when
handling complaints.

 

Case Examiners

 

The GMC employs medically qualified case examiners and lay case examiners
to provide advice and decisions on complaints. Case examiners have a range
of input into fitness to practise procedures, from advising whether a full
investigation is necessary to agreeing what evidence should be gathered,
to deciding whether a case should be referred to a hearing.

 

Where a complaint is about medical treatment the doctor provided (this is
not always the case), the Assistant Registrar (AR) can seek advice from a
Medical Case Examiner (MCE) on about whether the correct medical treatment
or procedures appear to have been followed based on the complaint details.
This advice informs the AR as to whether a full investigation is required.

 

The MCEs have a range of specialties and specialist interests from General
Practice to Anaesthetics to Psychiatry. These specialist interests are
taken into account when seeking advice from the most appropriate MCE,
alongside availability and workload considerations.

 

The main function of the CEs is at the end of an investigation. At this
point the case is referred to both a MCE and Lay CE for decision. They
decide whether to conclude the case with no action, refer the doctor to a
fitness to practice hearing, issue a warning or propose undertakings.

 

Independent Medical Experts

 

During a full investigation an Independent Expert may be asked to produce
a report giving their opinion on the treatment provided by the doctor
concerned. MCE’s often advise as to whether and expert report is required.
These experts are chosen based on them having equivalent or higher level
of experience to that of the doctor being investigated. They make a
recommendation to the GMC as to whether the doctor’s standard of care met
or fell below that expected of a reasonably competent doctor in their
particular role/specialty. The Independent Expert’s report forms part of
the evidence which the MCE and Lay CE consider when deciding how the
investigation should be concluded.

 

Assistant Registrars (ARs)

 

You also asked about the qualifications of ARs. ARs are not required to be
medically qualified. They are trained in the rules, guidance and
thresholds for conducting fitness to practise investigations. As mentioned
above, they seek advice from a MCE on medical issues where necessary.

 

Their role on a case includes making the initial decision as to whether a
complaint should be investigated, advising on how to proceed if adverse
information is received from the doctor’s employers and advising the
Investigation Officer on other matters as necessary.
