The additional information you now request is exempt from disclosure under Section 40(2) as it constitutes a request for personal data about the authority’s employees. To disclose this information would contravene the first data protection principle; that the processing (in this case the disclosure) should be fair and lawful. If disclosure would not be fair, then it would contravene the first DPA principle and the information is exempt under FOIA section 40(2).

When considering whether disclosure would be fair, the Council has to give regard to whether it is sensitive personal data, the consequences of disclosure, the employees’ reasonable expectations and the balance between their rights and the legitimate interests of the public in disclosure. It is considered that employees would have a reasonable expectation that this personal data would not be made public and as such the Council relies upon Section 40 (2) of the Act to refuse your request.

If you are dissatisfied with the handling of your request, you have the right to ask for an internal review. I believe that the qualifications or lack of should not be exempt and parents should be able to know how qualified any person dealing with their child is.

Further to your email seeking clarification of the terminology used in the Council's response to your enquiry, we can advise the following.

A teacher induction is a programme introduced in September 2012 whereby any Newly Qualified Teachers at that time, or after, are required to complete a statutory assessment known as Induction Arrangements for Teachers.

Statutory induction is the bridge between initial teacher training and a career in teaching. It combines a personalised programme of development, support and professional dialogue with monitoring and an assessment of performance against the relevant standards. The programme should support the newly qualified teacher (NQT) in demonstrating that their performance against the relevant standards is satisfactory by the end of the period and equip them with the tools to be an effective and successful teacher.

The length of the induction period, whether the NQT be full time or part time should be the equivalent to one school year (approximately three school terms). The outcome of this is then forwarded to the Department for Education.
