PZL-104 Wilga (Golden Oriole) Plane Crash May 6th 2010

Dear Northamptonshire Police,

Please could you supply any and all information and working papers
relating to the AAIB Investigation that was formally launched on
May 6th 2010 relating to the crash of a PZL-104 Wilga (Golden
Oriole) outside Banbury.

Can you please confirm also as to whether that criminal investigation is
still ongoing , and if so, when do you expect to produce a final
report on the circumstances of the loss of the aircraft.

If in fact the investigation was terminated without issuing a
formal report, please provide a full accounting and formal
explanation as to how that decision was made that no further criminal investigation was warranted in view of the
statutory obligations of your unit in relation to aviation
incidents within UK airspace resulting in the loss of aircraft and
serious injury, and in light of the lack of the issuing an official report on the part of the Air Accident Investigation Branch branch to date, conclusively ruling out the commission of any crime in relation to the incident.

For your reference, I have also submitted a parallel FOIA Request to AAIB in regard to this matter (F0012099) and am currently awaiting a formal response to my request.

I can confirm that Northamptonshire Police holds the information requested
in relation to an incident log which I have attached. This information has
been redacted to remove personal information according to Section 40 (1 ‚Äď
3) of the Freedom of Information Act in relation to personal information,
this is an Absolute Class Based Exemption. There was no police criminal
investigation other than attending the scene and arranging the taking and
submitting of blood samples from the pilot on behalf of the AAIB.  Any
information collated by the police at the time was handed over to the AAIB
and formed part of their investigation.

 

The AAIB investigation was completed and their report published in
November 2010.  It is available through the following link:

The working papers of the AAIB are exempt from disclosure by virtue of
Section 44(1)(a) as to disclose this information would be a breach of EU
Regulation 996/2010, Article 14. As any papers collated by the police were
handed over and used by the AAIB and as such are subject to the same
exemption.

Northamptonshire Police provides a review and appeals procedure within the
terms of the Freedom of Information Act 2000. If you decide to make an
appeal and, having followed the full process you are still dissatisfied,

'a' attached.
