Please could you supply any and all information and working papers relating to the AAIB Investigation that was formally launched on May 6th 2010 relating to the crash of a PZL-104 Wilga (Golden Oriole) outside Banbury.

Can you please confirm also as to whether that investigation is still ongoing , and if so, when do you expect to produce a final report on the circumstances of the loss of the aircraft.

If in fact the investigation was terminated without issuing a formal report, please provide a full accounting and formal explanation as to how that decision was made in view of the statutory obligations of your unit in relation to aviation incidents within UK airspace resulting in the loss of aircraft and serious injury.

Thank you for your email which was received by the Air Accidents Investigation Branch (AAIB) on Wednesday 11th February 2015. You have asked for all information and working papers relating to the AAIB investigation to the crash of a PZL-104 Wilga (Golden Oriole) outside Banbury on the 6th May 2010.

You have asked for this information under the Freedom of Information Act.

You have asked whether the investigation is still ongoing. I can confirm that the AAIB has completed its investigation and the report was published in our November 2010 bulletin. I attach a link of the AAIB report.

You have asked for all working papers on the investigation. The AAIB is prohibited from releasing this information, specifically under EU Regulation 996/2010, Article 14, paragraph (1)(d).

Article 14-EU Regulation No 996/2010

Protection of sensitive safety information

1. The following records shall not be made available or used for purposes other than safety investigation:

(d) Material subsequently produced during the course of an investigation such as notes, drafts, opinions written by the investigators, opinions expressed in the analysis of information, including flight recorder information.

Section 44(1)(a) of the FOI Act provides an exemption from the duty to disclose information where disclosure is prohibited under any enactment. In this case EU Regulation 996/2010, Article 14. (1)(d). To disclose the information you have requested would be incompatible with the Regulation and be contrary to UK and European Law. Section 44 is an absolute exemption under the Freedom of Information Act.
