Good Morning,

My name is Helen Hoddinott and I am writing with a request under the Freedom of Information Act. Specifically, I would to ask for the following information:

- Please could you provide the total number of suspensions given as a result of a pupil vaping on or near a school's premises, broken down into academic years 2021-2022, 2022-2023 & 2023-2024.

- For the same academic years, could you please provide which school years each of the suspended pupils were in and the gender of suspended pupils.

- Please provide the total number of days these students were suspended for as a result of being caught vaping for the same academic years.

Further to your request for information under the Freedom of
Information Act 2000, dated 9^th September 2024, please find E‐ACT’s
response as follows:

 

After careful consideration, we must inform you that we are unable to
provide the detailed information you have requested. While we strive to be
as transparent as possible, we must also protect the privacy of our
students and comply with data protection regulations.

 

In accordance with Section 40(2) of the Freedom of Information Act 2000
(FOIA), we are exempting the release of the requested data because it
contains personal data of third parties. Disclosure of this information
would contravene the data protection principles as set out in the Data
Protection Act 2018 and the UK General Data Protection Regulation (UK
GDPR). Specifically, the requested data, even in aggregate form, could
potentially lead to the identification of individual pupils given the
small number of instances (fewer than 5 for each of our schools for each
of the academic years) and the specificity of the accompanying details
(year groups , gender, length of suspension).

 

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of receipt of the response to your
original letter and should be addressed to [1][email address].  Please
remember to quote your reference in any future communications.   

 

If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner
for a decision. The Information Commissioner can be contacted at:

I can assure you the information would not compromise the privacy of your students, please could you explain why you feel it would?

As a compromise, please could you provide simply the number of suspensions for vaping over the last three academic years, broken down by year, and the total days those suspensions run to?

While we understand your perspective and appreciate your reassurances, the E-ACT Trust has to follow the ICO guidelines which I have explained in our previous email.

The new format of your request could still potentially lead to the identification of individual pupils given the small number of instances (fewer than 5 for each of our schools for each of the academic years).
