Thank you for your email dated 3 April, requesting a copy of the 200-case
dossier compiled by the NASUWT teaching union regarding student input into
teaching appointments. I have dealt with your request under the Freedom
of Information Act 2000 (the Act)
The Department holds this information, however, we consider that
the s36(2)(c) exemption is engaged.
Section 36(2)(c) is designed to protect information, the disclosure of
which would otherwise prejudice, or would be likely otherwise to
prejudice, the effective conduct of public affairs. In the period prior to
the general and local elections the Department considers that the public
interest is not likely to be served by our responding fully to your
request at this stage. As required under the Act, the opinion of the
Department's `qualified person' (a Minister) has been obtained to the
effect that the exemption is engaged.
We shall though aim to provide you with the information as soon as
practicable after the elections.
If you have any queries about this letter, please contact me. Please
remember to quote the reference number above in any future communications.
If you are unhappy with the way your request has been handled, you should
make a complaint to the Department by writing to me within two calendar
months of the date of this letter. Your complaint will be considered by an
independent review panel, who were not involved in the original
consideration of your request.
If you are not content with the outcome of your complaint to the
Department, you may then contact the Information Commissioner's Office.

Dear Mr Elibank,
Thank you for your email of 21 April 2010 asking for the broad basis on
which we applied the Section 36(2)(c) exemption.
On this occasion we engaged the s36(2)(c) exemption as some of the case
studies contained within the document you requested had received
considerable media interest in recent weeks, and the document had the
potential to be used for political gain in the run up to the General
Election. As we are no longer in purdah I am attaching the document as
promised.
