Pupil data: licensing agreements

Dear Department for Education,

with reference to pupil data receipients since 2012, please provide original copies of the licensing agreements between the DfE and the recipient / recipient's organsiation for the use and restrictions on the data sent, which are not included in the application documents:

These should be copies of original agreements, made in conjunction with these data releases, which outline the terms of use of the data for example, but not exclusivly, regards re-use, onward use by other third parties, onward selling in any format of any of the data provided under these requests.

Please also provide copies of any currently valid agreements for the companies RM Education and FFT regards their use of pupil data, other than the application request forms already provided via the link above.

The Department holds the information you have requested.  However, the
Department estimates that the cost of complying with your request would
exceed the cost threshold applicable to central Government. This is £600
and represents the estimated cost of one person spending 3½ working days
locating, retrieving and extracting the information.

However, if you were to make a new request for a narrower category of
information or limit the scope of your request, the Department may be able
to comply with your request within the cost limit, although I cannot
guarantee that this will be the case. 

 

 

Providing copies of the agreements for the specific cases (A- L) mentioned
would be manageable and within the cost threshold. However, providing
copies of any other current valid licensing agreements held between the
DfE and the organisations requested, would impact the cost threshold due
to the number of cases in question.

If you are unhappy with the way your request has been handled, you should
make a complaint to the Department by writing to me within two calendar
months of the date of this letter.  Your complaint will be considered by
an independent review panel, who were not involved in the original
consideration of your request.  

If you are not content with the outcome of your complaint to the
Department, you may then contact the Information Commissioner’s Office.

In signing the ‘Schedule to the Agreement for the supply of NPD / Linked
Data’, individuals are agreeing to the terms and conditions set out within
the ‘Agreement for the supply of NPD/ Linked data’. These individual
schedules must be signed and returned to the DfE before any data is
shared. In addition, we ask that each permitted user signs an ‘Individual
Declaration form’ before access to data from the NPD or Linked Data is

For i. 29/07/2013 - Fischer Family Trust Education Limited (FFT), this
case was approved before the current process was introduced in November
2013. It was superseded in July 2014 by data request DR140723.02 which was
superseded by a Service Level Agreement in January 2016.
