Please can you provide the following information under the terms of the FOI act 2002.

Terms and agreements between the DfE (and /or parties on its behalf) and Capita Business Services Limited, trading as Education Software Solutions, a company registered in England No. 2299747, (hereinafter referred to as ‘Capita’) of 30 Berners Street, London, W1T 3LR for provision of services for the purposes of

A) delivery by Capita of services / school systems upon which the school census data delivery to the DfE depend

B) any impact or risk assessment of Capita in its service delivery (including but not only the impact of any merger, acquisition or new ownership)

and

C) managing primary school tests for the DfE Standards and Testing Agency

This is requested with the aim of supporting understanding and transparency of the prospective sale of Capita SIMS reported in the press in November 2020; on public service delivery, and for both children and workforce whose data are jointly controlled or processed by Capita in its provision to schools and for the school census, and attainment testing.

This is requested with the aim of supporting understanding and

I have dealt with your request under the Freedom of Information Act 2000
(“the Act”).
 
I have separated the response, as per your request for terms and
agreements between the DfE (and/or parties on its behalf) and Capita
Business Services Limited (trading as Education Software Solutions), into
the following:
 
1. With regards to the request for ‘delivery by Capita of services /
school systems upon which the school census data delivery to the DfE
depend’ – The DfE does not enter into agreements with suppliers of
management information systems (MIS) to schools to support provision of
the school census to the department. School MIS are commercial products
with the contractual arrangement a matter between the individual school
(or local authority or trust on their behalf) and the software supplier.
As such, no agreement in scope of this part of your request exists.
 
2. With regards to the request for ‘any impact or risk assessment of
Capita in its service delivery (including but not only the impact of any
merger, acquisition or new ownership)’ - No impact or risk assessment in
scope of this part of your request exists.
 
3. With regards to the request for ‘managing primary school tests for the
DfE  Standards and Testing Agency’ – The Standards and Testing agency has
contracted Capita to deliver test operations services and the contract has
been published on Contracts Finder, accessed via the following link:

request and wish to make a complaint or request a review of our decision,

Generally, however, the ICO cannot make a decision unless you
have already exhausted the department's complaints procedure.
