Dear Academies Enterprise Trust,
Please pass this on to the person who conducts Freedom of Information reviews. Thank you for your reply of October 10, 2019.
I am writing to request an internal review of Academies Enterprise Trust's handling of my FOI request 'Pupil data: AI introduction Steer / Mind World Ltd.' and that you provide the requested information in accordance with the FOI Act 2000.
Although you replied that you are unable to provide a copy of the DPIA and other information as the document contains both personal and commercial information you are able to redact personal data and provide the rest. You have not disclosed the exemptions that you have applied.
Such an exemption, were it for example section 43, is not absolute, and requires you to apply a public interest test. You must consider the public interest arguments before deciding whether to disclose the information and that should form part of the response. In addition to the information that you must provide (excluding the potentially very narrow parts of the information that fall under the exemption after the balancing test) you may in addition have to disclose the rest of the information in spite of an exemption, where it is in the public interest to do so. For example, what you consider data with prejudice forcommercial data.
For guidance on redaction we recommend the ICO guidance: https://ico.org.uk/media/2013958/how-to-...
A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/p...
Thank you for your re-consideration, and I look forward to the information.
Sincerely,
Jen Persson
