Punishments for Littering Offences

Dear Trafford Council

I would like to know about the penalties you have issued for the offence of littering. I am particularly interested in car drivers who are fined or prosecuted for the offence of throwing a cigarette butt out the window.

To make my request clear, I would like to know:

1. The number of council officials empowered to give out fines for environmental offences.

2. The total number of fixed penalty notices, and prosecutions, for the offence of littering, over the past year. Could you please state the total income received by the council from these fines and prosecutions?

3. Could you confirm that there are council vans which - as part of their clean-up duties - follow car drivers who are smoking, to ensure that they do not discard the cigarette butt out of the car window? Could you state how many vans are employed to this end? If possible, could you state how many fines or prosecutions this operation has led to, over the past year of available data - and the income received from these fines and prosecutions.

Dear Ms Appleton

I refer to your request below. I can give you the following information.

Since 2006/07, the Council has issued 6,442 Fixed Penalty Notices for smoking-relating litter offences. Of these 5,869 have either been paid, or the offender prosecuted. Since June 2011, the system for recording FPNs has changed, and we have no way of reporting information about litter types.

I refer to your request below. I can give yuou the following information.

1. There are 17 staff are empowered to issue Fixed Penalty Notices for a range of environmental offences.

2. Since April 2011, Council officers have issued 3,239 FPNs for litter offences. In the same period 2,692 FPNs have been paid, worth a total of £134,600. There have been 130 successful prosecutions, with £21,120 fines issued by the Magistrates, and £11,783 awarded to the Council in costs.

3. It is not Council policy to actively or aggressively follow any vehicle. Officers carry out patrols in vehicles, and foot patrols in litter hot spots, and will take steps to take enforcement action when they see an environmental offence being committed.
