Dear Cornwall Council,

To promote openness and transparency with the communities they serve, public bodies are asked to maintain a Freedom of Information Register on their website. Government guidance states organisations maintained by the public purse should publish an up-to date register of all Freedom of Information requests. This prevents duplication of requests and promotes accountability.

Currently Cornwall Council do not make their Freedom of Information Register available to the public.

Under FOI Act 2000: please provide me with details from your
Freedom of Information Register. Please provide this information in an Excel (not a pdf) format and provide details of all FOI requests you have received since Jan 2005 to date, in date order.

For each FOI request, please provide the following information:

1. Subject/title of the individual request.
2. The name of the requester
3. Reference number or identification number of each request.
4. The date the request was made.
5. The date the Council acknowledged receipt of the request.
6. The date the information was released
7. How many working days it took to provide the information to the satisfaction of the person making the request.
8. The current status of each request: whether the information was fully released, partially released, withheld or whether the case is ongoing.
9. If the FoI request was refused – please provide the date and reason given.
10. How many internal reviews have been requested?
11. How many complaints have been received relating to your FOI process?

Please also confirm:

12. Please confirm the dates FOI compliance has been discussed by Cornwall Council Cabinet or full Council or Officer meetings and provide the minutes of those meetings.
13. What plans are currently underway for Cornwall Council to publish its FOI register?
14. What date will Cornwall Council comply with Government recommendations to publish its FOI Register online?
15. Please confirm the name of the employee legally responsible for FOI compliance and for ensuring procedures are in place to systematically review the arrangements for administering and managing FOI requests.

Thank you for your letter; I quote...

The Council may be able to assist you with your request if you are willing to narrow the terms of the search in the following ways:
Narrow the scope of question 12 to include information relating to the Unitary Authority only (from April 2009). Narrow the scope of question 12 to Cabinet, full council meeting and Corporate Leadership Team meetings. A central register of all meeting agendas is not held and it would exceed the appropriate limit to search for additional meetings and minutes.
Narrow the scope of question 5 to include information for the last financial year only. Information regarding the date requests are acknowledged is not held centrally and the file for each request would have to be searched to provide this.
Please contact me as soon as possible if you would like to narrow your request in order for us to search for and provide some information to you.
Please note that until we receive confirmation that you would like to narrow your request, we will not be able to start processing your request, and the 20 working day limit will not begin. If we do not receive a response to this letter within three months of the above date, we will assume the request to have lapsed as we are unfortunately unable to complete the request with the details that have so far been supplied.

We deleted a response from Cornwall Council dated 10 February 2011 due to a bulk accidental release of personal information via that response.

We were alerted to the issue on 21 February 2021 and we ceased publishing the material that day.

We have reported the issue to both the council and the Information Commissioner and we have cooperated with an investigation by the council.
