Dear North East Lincolnshire Council,
I cant help but see that a lot of allegations made towards you show more and more somewhat correct i have checked your public spending and and an extremely long list of ltd companies registered on companies house it would appear the suppliers you purchase from do relate back to your selves via office addresses or po box or addresses owned by your selves..?! and coucilors names also there addresses and staff with some anagram formation?? Can you ellaborate for us to understand why this is possibly??

For a request to be valid under the Freedom of Information Act, section 8
(1) requires that it

 

(a) is in writing,

(b) states the name of the applicant and an address for correspondence,
and

(c) describes the information requested.

 

The Information Commissioner’s guidance ‘Recognising a request made under
the Freedom of Information Act (Section 8)’ clearly states that ‘the
intention of the legislation is for the requester to provide their real
name’. Where a request is made not using the applicant’s real name this
would render the request invalid and affect your appeal rights, as the
powers of the Information Commissioner only extend to requests for
information defined under section 8 of the Act.

It is not clear from your above request what recorded information you are
requesting from North East Lincolnshire Council. Please can I ask that you
clearly confirm the specific recorded information you require. 

 

It may be helpful if I explain that the Freedom of Information Act (2000)
gives individuals and organisations the right of access to all types of
recorded information held, at the time the request is received, by public
authorities such as North East Lincolnshire Council. Section 84 of the Act
states that in order for a request for information to be handled as a
Freedom of Information (FOI) request, it must be for recorded information.
For example, a Freedom of Information request would be for a copy of a
policy, rather than an explanation as to why we have that policy in place.
On occasion, North East Lincolnshire Council receives requests that do not
ask for recorded information, but ask more general questions about, for

For example, a Freedom of Information request would be for a copy of a policy, rather than an explanation as to why we have that policy in place."

They are suggesting that freedom of Information requests are invalid if they ask a question, or ask for an explanation. They should refer to the guidance on the Information Commissioner’s website under the heading; “Can a question be a valid request?”. It is clearly the Commissioner’s view that not only a question may be a valid request but asking for an explanation also may be valid.
