Dear Office for National Statistics,

I understand that in 2007 the Office for National Statistics joined the Public Sector Flex service.

Under the Freedom of Information Act please can you provide me with copies of:

1. Any reports or business cases prepared by or for the Office for National Statistics upon which the decision to join the Public Sector Flex service was based.

2. Copies of any internal reports prepared by or for the Office for National Statistics subsequent to signing the contract concerning progress made on implementing the Public Sector Flex service.

3. Confirmation of when the full Public Sector Flex shared service was delivered to the Office for National Statistics(eg a copy of the acceptance certificate for the new service). (This refers to the full shared service rather than merely taking over any existing service from previous
suppliers.)

4. Copies of any internal reports, memos or meeting notes made subsequent to meetings of the Flex Framework Board.

5. Copies of any correspondence with Fujitsu and/or the Cabinet Office after 1 January 2008 concerning the implementation of the Public Sector Flex service.

Whilst I appreciate that some of this material may be commercially sensitive and potentially exempt from publication under s43 of the Act, as this is a qualified exemption I would expect you to take full account of the value of the contract in the current economic climate and the clear public interest in transparency.

Service. I am writing to confirm that the Office for National Statistics
(ONS) has now completed its search for the information which you requested
and part of the information is enclosed.

Full Public Sector Flex has not yet been delivered to ONS. This is a staged
delivery to be implemented in tiers, and Fujitsu has taken over the "as is"
service, but no transformation towards the flex shared service has been
made. We are currently in commercial negotiations with Fujitsu on
implementation consequently we can not provide this information at this
stage.

It is our view that we are unable to provide details regarding copies of
any internal reports, memos or notes made subsequent to meetings of the
Flex Framework Board as this information is exempt from disclosure under
Section 43(2) of the Freedom of Information Act, Commercial Interest.
Sections 43 (2) Information is exempt if its disclosure under the FOI Act
would, or would be likely to, prejudice the commercial interests of any
person (including the public authority holding it). It is our opinion that
ONS's interests would be prejudiced by release of this information at this
stage and that the public interest in maintaining this exemption outweighs
the factors in favour of disclosure. Whilst we recognise that there are
arguments in favour of disclosure and transparency ONS is still involved in
negotiations with a third party and release of information at this time
would prejudice ONS's ability in securing the best possible deal for the
public finances.

5. Copies of any correspondence with Fujitsu and/or the Cabinet Office
after 1 January 2008 concerning the implementation of the Public Sector
Flex service.

I am unable to provide you with this information as it would fall within
the scope of the exemption under S35 (1)(a) Formulation of government
policy. This exemption is engaged in respect of all the information within
the scope of your request because it relates to the formulation and
development of government policy. As this is a qualified exemption under
the Act ONS is required to balance the public interest in releasing the
information against that in withholding the information.

ONS recognises the general public interest in openness, transparency and
being able to hold government to account; it accepts that release of the
information could give the public insight into the implementation of the
Public Sector Flex service. However it must be bourne in mind that these
papers related to a on-going issue that is currently still the subject of
commercial negotiations, subsequently it must recognise that release of the
information would prejudice effective policy formulation and development
through inhibiting the free and frank provision of advice and exchange of
views. In ONSs view the balance of public interest therefore falls clearly
in favour of withholding this information.

You have the right to have this response to your freedom of information
request reviewed internally by an internal review process and, if you
remain unhappy with the decision, by the Information Commissioner. If you
would like to have the decision reviewed please write to Frank Nolan,
