Dear Lancashire County Council,

A couple of years ago, you kindly supplied Adam Snape with a copy of your Public Rights of Way GIS data, along with permission to reuse it under the Open Government Licence [1]. I would now like to request an update to the this dataset. Specifically:

1/ Under the Environmental Information Regulations [2], please supply me with an updated copy of the GIS data for the working (unofficial) version of your Definitive Map of Public Rights of Way. My preferred format for this would be one of KML, GeoJSON, MapInfo or Shapefile. (If a different format is more convenient for you, I'm happy to discuss this.)

2/ Under the Re-Use of Public Sector Information Regulations [3], please grant permission to re-use the information in that dataset under the Open Government Licence v3 [4]. The purposes for which I wish to re-use the data are (a) to help improve the representation of Rights of Way in OpenStreetMap and (b) to make the dataset available to others under an open licence in convenient open formats.

3/ In compliance with the final bullet point on page 1 of the ICO's Model Publication Scheme [5] (which you are required to have adopted) I would like to request that you arrange to pro-actively publish updates to your PRoW GIS data on your website going forward. I would suggest that quarterly updates would be reasonable. (Please don't let your consideration of this part slow down your response to the first two requests. I am more than happy for you to take longer to consider this part, as long as I get a prompt response to requests 1 and 2.)

The digitised rights of way information should be used for guidance only
as its accuracy cannot be guaranteed. The Public Rights of Way information
aims to show the approximate position of the Public Rights of Way, however
this must be verified on the Definitive Map and Statement, which is the
legal document of Public Rights of Way.

 

Please note that there may also be unrecorded rights of way which are not
currently shown on the digitised file. Routes may be added onto the
Definitive Map via a Definitive Map Modification Order if evidence shows
that a route has been used for 20 years or more without interruption.

 

The shapefile attached is a snapshot taken from dynamic data, it is
constantly subject to change as part of the continuous review and
therefore it is only correct at 05/06/2020.

 

Please ensure that you use the data for your analysis only and that it is
not passed on to other parties or used for other purposes.

 

If you have any queries regarding any of the above, or you require any
additional information, please do not hesitate to contact the team quoting

Many thanks for responding to my FOI/EIR request so promptly. Unfortunately you have only responded to part 1 of the three parts of the request. Part 2 was the following:

Could you please respond to this at your earliest convenience. Note that you have previously granted this permission to me before for a previous version of the same data. Yet your response this time explicitly said "Please ensure that you use the data for your analysis only and that it is not passed on to other parties or used for other purposes." If you do not grant the requested licence for re-use, then you will need to make a formal refusal under the Re-Use of Public Sector Information Regulations.
