Dear Information Commissioner’s Office,

I am writing to request recorded information about the public register of data controllers. I am asking these questions because I cannot find an entry for Chris Huhne MP on the register yet he publishes an email address for constituency casework on his website (http://www.chrishuhne.org.uk/contact).

I understand also from the Parliament website that "Individual Members of Parliament (MP's) are data controllers in their own right."[http://www.parliament.uk/site-informatio...

1. Is Chris Huhne MP currently registered* in his capacity as an MP?

2. Has Chris Huhne MP at any time registered in his capacity as an MP?

3. Please could you provide me any correspondence in relation to any attempt (whether successful or not) by Chris Huhne MP to register in his capacity as an MP.

4. Please could you let me know what checks the ICO has done to ensure that each MP elected at the last general election have registered.

*I use the word 'registered' to mean having notified such as to ensure an entry appears on the public register of data controllers.

Dear Mr Cross,

I write further to our email of 25^th July 2011 in which we acknowledged
your request for information to the Information CommissionerÂ’s Office.

As previously explained we are treating your request as a request for
information under the Freedom of Information Act 2000 (the FOIA).

In your request dated 23^rd July 2011 you asked for the following:

“1. Is Chris Huhne MP currently registered* in his capacity as an
MP?

2. Has Chris Huhne MP at any time registered in his capacity as an
MP?

3. Please could you provide me any correspondence in relation to
any attempt (whether successful or not) by Chris Huhne MP to
register in his capacity as an MP.

4. Please could you let me know what checks the ICO has done to
ensure that each MP elected at the last general election have
registered.

*I use the word 'registered' to mean having notified such as to
ensure an entry appears on the public register of data controllers.”

Our Response

I shall address each of your questions in turn and have therefore numbered
my responses in line with each question you asked.

1. Christopher Huhne MP is not currently on the public register of data
controllers.

2. Christopher Huhne MP has been registered previously. He was registered
from 18 June 2002 to 17 June 2011. His previous registration expired on 17
June 2011 – he was registered under registration number Z6775169.

3. I should explain that 42 days prior to expiry our notification system
automatically generates a renewal reminder. If we do not receive payment
for a register entry or we have not been advised that the register entry
is no longer required, a further automatic reminder is sent out. Due to
this being an automated process we do not retain copies of the individual
letters, rather we retain the information concerning when letters have
been sent however I have attached copies of the template letters for your
information so you can see the information Christopher Huhne MP will have
received. Attached to these letters when they are sent out would be a
tiered assessment notification form, amendment form and direct debit form.
I can confirm that automatic reminder letters were sent to Christopher
Huhne MP on 6^th May 2011 and 27^th July 2011.

It may also be helpful for you to know that if we do not receive any
correspondence or a notification fee from Christopher Huhne MP our
notification team have confirmed a final reminder will be issued before
this matter will be passed to our non notification team for further
action.

4. Our notification department have confirmed that after the last general
election the ICO carried out a notification check on all MPÂ’s
(including newly elected MPÂ’s) and subsequently contacted those
MPÂ’s that did not, at that time, have a current notification to ensure
they were aware of the need to register. Our non notification team are
still in the process of contacting recently elected MPÂ’s to ensure
they are aware of the need to notify and will take further action in
appropriate cases of non notification.

I hope that this response provides you with the information you require.

However, if you are dissatisfied with this response and wish to request a
review of our decision or make a complaint about how your request has been
handled you should write to the Internal Compliance Team at the address
below or e-mail [2][email address]

Your request for internal review should be submitted to us within 40
working days of receipt by you of this response. Any such request
received after this time will only be considered at the discretion of the
Commissioner.

If having exhausted the review process you are not content that your
request or review has been dealt with correctly, you have a further right
of appeal to this office in our capacity as the statutory complaint
handler under the legislation. To make such an application, please write
to the Case Reception Team, at the address given below or visit the
‘Complaints’ section of our website to make a Freedom of
Information Act or Environmental Information Regulations complaint online.
