I am writing to request an internal review of Mid Ulster District Council's handling of my FOI request 'Public Parks and Play and Outdoor Recreation Strategic Plans'.

A response was not received within the statutory time limit.

The law states that FOI requests must receive a response within 20 working days. Certain circumstances may allow extra time, however, in all cases the requester must receive a written response within the standard time limit for compliance. No such response with explanation of the delay has been received.

During a phone conversation with Philip Moffett on Thursday 13 September I was advised this and other FOI requests made on 10 August had been batched for response and had been unduly delayed without receipt of response or explanation within the statutory time period.

I was told that I would receive responses on Friday 14 September or no later than Monday 17 September. A further phone conversation with Philip Moffett on Monday 17 September confirmed I would receive the responses by the end of the day. I was then informed that the Development Department overseeing the responses had not had time to look at them and I would not receive the information within this timeframe. No explanation for this, nor the delay during the statutory time limit, has been received.

I am asking that you please supply the information requested and conduct an internal review on the handling of this request.

Thank you for your information request submitted with Mid Ulster District
Council on 10/08/2018 under the Freedom of Information Act 2000 (the Act)
requesting the latest draft and any versions of the Public Parks and Play
and Outdoor Recreation Strategic Plans.  I apologise on behalf of council
for the delay in a response being issued to you.  The Council responds as
detailed.

The Council has considered your request and confirms that it is currently
developing the above referenced documents specific to Mid Ulster
district.  As these documents are intended for future publication the
council is unable to release them at this time under Section 22(1)(a)
(information intended for future publication) of the Freedom of
Information Act 2000.  The council, however, confirms that it intends to
publish both plans following approval by the Council at a future date.

 

I hope this is of assistance. However, under the Freedom of Information
Act, if you are not happy with the way in which your request has been
handled, you have the right to ask for an internal review. An internal
review should be requested within 2 months of the date of this response
