This letter is to inform you that it will not be possible to respond to
your request within the cost threshold.  

With regards to still imaging, the level of breakdown required plus the
total number of still images and video footage retained for the events
means that extensive work and detailed examination would be required to
provide this figure.  To give an indication of the amount of work
required, for the 4 events above a total of 88 DVD's were created for
stills images alone.  These comprised several different images taken by
different officers for different taskings.  

 We estimate that the cost of complying with this request would exceed the
appropriate limit. The appropriate limit has been specified in regulations
and for agencies outside central Government; this is set at **450.00.  
This represents the estimated cost of one person spending 18 hours [at a
rate of **25 per hour] in determining whether the MPS holds the
information, and locating, retrieving and extracting the information.

In accordance with the Freedom of Information Act 2000, this letter acts
as a Refusal Notice.

Section 17(5) of the Act provides:

(5) A public authority which, in relation to any request for information,
is relying on a claim that section 12 or 14 applies must, within the time
for complying with section 1(1), give the applicant a notice stating that
fact.

Section 12 of the Act provides:

(1) Section 1(1) does not oblige a public authority to comply with a
request for information if the authority estimates that the cost of
complying with the request would exceed the appropriate limit.

Under Section 16 (duty to assist) we are required to offer you the
opportunity to redefine your request.  It might be possible to answer
questions 2,3 & 4 subject to any relevent exemptions that might apply.

EXTENT OF SEARCHES TO LOCATE INFORMATION
To locate the information relevant to your request searches were conducted
at Public Order and Operational Support and The Directorate of Forensic
Services (SCD4).

DECISION

I have today decided to disclose the located information to you in full.
Please find attached information pursuant to your request above:

The RAW/Master data is stored by SCD4 both locally and subsequently at
alternative locations on optical disc (CD/DVD) with copies passed to the
post event teams for investigation.

The following is statistical data regarding the number of photos/videos
taken at the protests you have listed in your request. This data may not
be an accurate reflection of what was passed to the Public Order Command
(CO11) following processing by The Integrated Prosecutions Team as this
would require extensive work across numerous entries. It does however
represent the RAW data held on video tape and optical disc by the
Directorate of Forensic Services. Much of this data is now in archival
storage and to retrieve and examine each of these jobs would be both
costly and time consuming.

are currently stored in a format which makes them accessible to a
suitably authorised individual through the police national database
(PND). If yes, how many stills photographs are accessible in this

None of the images taken by SCD4(3) and sent to CO11 have been entered
onto the PND.

4. Whether any of these images / footage has been destroyed, in
which case how many / much has been destroyed. I would also request
copies of any documents that evidence this (appropriately redacted
if necessary).

There are still a number of court cases taking place in relation to the
student demonstrations and there are suspects still outstanding. These are
currently being handled by the police teams responsible for these
investigations. Any copies of images from the above mentioned events were
sent to the post event investigation team with responsibility for managing
suspects etc. Until it has been satisfied that all lines of enquiry are
complete, no weeding of images/footage will take place. Furthermore the
events were of national importance and have attracted a number of civil
claims made against the MPS. The events are of historic interest and it is
anticipated that the images will be retained for a period of 7 years when
a decision will be made to destroy or archive them.
