Hi,

You are required to publish a notice on your website advising of the 30 working day period in which local government electors, business rate payers and representative of those can request to inspect/copy various accounting records. This is in reference to the Local Audit and Accountability Act 2014 and underlying regulations such as the Accounts and Audit Regulations 2015.

Despite a search of your website I have yet to be able to find it and the legal requirement to publish this public notice in a newspaper has been dropped this year.

Please could you advise me of the start and end date of this period, or if the notice is already published on your website, bearing in mind your s.16 duty to provide advice and assistance, provide a link to it?

I write to acknowledge receipt of your email below which was received
today.  The invoices referred to are those already contained in your email
request dated 4 August 2016 (see attached).  I note that the list of
contracts is different so I will put these together and deal with them as
one response.

 

The notice was published on 1 July 2016 and the period for inspection will
therefore end on  12 August 2016.  (copy notice attached).   This notice
is not unfortunately on our website at this present time.

 

As you will appreciate you have requested a large amount of
information.    Officers are working as quick as possible to retrieve the
information requested and we hope to provide you with a copy in the next
few days.

 

I understand that you have also requested information regarding inspection
dates through an FOI request.  This therefore constitutes a response to
that too.

Dear John Fogarty and Louise Outram, 

Please note this is a combined request for Merseytravel and the Liverpool
City Region Combined Authority. From my perspective it would make sense to
deal with these both on the same day (but I realise from your perspective
you may prefer to deal with them separately). 

I am copying in Louise Outram on this as I realise the legal section at
Merseytravel deals with the contracts element of this request. 

I'm a local government elector in the Merseyside area registered to vote
at Jenmaleo, 134 Boundary Road, Bidston, Wirral, CH43 7PH. 

As (I presume) it is within the 30 day working period I would like to
inspect & receive copies of the invoices in the attached spreadsheet
(supplied in comma separated value format) and the following contracts. 

Please note also that the list of reasons for redactions have changed
since last year.

List of contracts

1) Contract/s with Merseyrail Electrics 2002 Limited 

2) Lease with Commerz Real Investmentgesellschaft GMBH for Mann Island HQ

3) Contract/s with BLACC Consulting Ltd

4) Contract/s with Kenyon Fraser

Please could you suggest suggested days and times to inspect these
documents with the 30 working day period?

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Merseytravel's handling of my FOI request 'public notice about Local Audit and Accountability Act 2014,s.26 and s.27 relating to 2015/16 FY'.

Sorry the FOI request for the public notice was meant as a separate issue to the request for invoices/contracts (which is not a FOI issue).

You are right an email was sent on the 4th August 2016 and another today on the 8th August 2016.

Unfortunately that was because I had not received a reply to my email sent on August 4th 2016 and thought I absentmindedly therefore hadn't sent it!

However, although the copy of the public notice in the newspaper is part of the request and is useful, you have not provided a link to the copy of the public notices on your website (which was part of this original request). Nor have you given a refusal notice as to why you can't provide it, hence the rationale for this internal review.

Our initial response was not a refusal to provide you with the requested
information, but rather advising you that the information was not on our
website.  Merseytravel therefore had no recorded information to provide to
you.
