Public Interest Test

The request was successful.

In your response to my FOI request of 16 August 2023, you included this information:
'Section 31(1)(g) leading to section 31(2)(d)
This exemption relates to information which, if disclosed, would be likely to prejudice our regulatory function of assessing doctors’ fitness to practise. This exemption is subject to a public interest test. In this case I believe that the public interest in withholding this information
outweighs the public interest in disclosure.’

1. Please provide the GMC check list for its 'public interest test’.
2. Who makes the decison whether or not something is in the public interest.
3. What is the GMC definition of 'public interest'?

Thank you

Dear Sasha Rodoy

Your information access request IR1-4116598544

Thank you for your email of 13 October asking for information relating to
our public interest test and definition of ‘public interest.’ I’ve
considered your request under the Freedom of Information Act 2000 (FOIA).

 1. Please provide the GMC check list for its 'public interest test’.

We don’t have a checklist for public interest tests. Where necessary we
refer to best practice including the [1]guidance provided to public
authorities by the ICO.

     2. Who makes the decison whether or not something is in the public
interest.

In the context of requests for information, this decision is made by the
Information Access Team, with input and advice from other teams if
necessary.

 3. What is the GMC definition of 'public interest'?

We don’t have our own definition of ‘public interest.’ In relation to
requests for information under the FOIA, we follow the definition of the
public interest given in the ICO guidance I’ve linked to above.

I hope you find this information useful. If you have any queries about
this, or need anything further, please contact me on the details below.

Yours sincerely
