The request was refused by Post Office Limited.

Dear Post Office Limited,ICO guidelines say this re Public Interest test"there is a public interest in:,good decision-making by public bodies,
upholding standards of integrity,
ensuring justice and fair treatment for all,
securing the best use of public resources, ".In the light of the forementioned why are attempts to overturn Horizon based and spuriously obtained confession convictions being disputed by POL?What Dept. or named Individual is making these decisions, what documents do you hold concerning discussions about contesting Appeals since 2019?

Yours faithfully,

john o'sullivan

Dear john o'sullivan,

Thank you for your email.

Unfortunately, we need further clarification to understand exactly what information you are seeking, before we can begin to process your request. You refer to "Public Interest FOI Guidelines" in the heading of your email and then you provide a quote, referring to ICO guidelines, in the body of your email. You then refer to convictions being disputed by POL, individuals making decisions and documents concerning contesting appeals since 2019, in the body of your email.

The Freedom of Information Act 2000 and prosecutions/appeals are completely separate processes/legislations, and so FOI guidelines would have no bearing on any legal decisions made relating to prosecutions/convictions or appeals. We would therefore appreciate if you could clarify the exact information you are seeking, as it is currently unclear from your original email.

Once you are able to do this, we will go ahead and process your email in the most appropriate manner.

If you need further assistance in formulating an FOI request, please take a look at the following ICO guidance:

Dear [email address],Thank you for a reply,What test or guidance did the Post Office use when
determining whether or not to recommend a charge or to continue to proceed with a
case against a defendant at court in original Horizon Prosecutions and more recently when choosing to oppose
appeals to have convictions overturned? As this headline in the FT suggests"Post Office told UK government it would oppose appeals by half of convicted sub-postmasters"Treat this as a new Inquiry if you must,John

Dear [email address],Thank you for a reply. Is it current Post Office belief that a Horizon printed balance is of itself evidence of a loss if it is at odds with stock/cash held in branch?Or is the Subpostmaster given the benefit of the not inconsiderable doubt. In past case were the only evidence was a Horizon report and trading statement signed by the SPM would this give POL the confidence to oppose appeals?Do two different tests apply to the same Horizon generated figures?

Yours sincerely,

john o'sullivan

Dear information.rights,Thank you for a reply,im not much good at this but as father time plods his weary way along and questions get asked about all sorts of matters, what POL knew, what Rodric knew(and Ben),what wasnt answered or paid out on technicalities at least we will have a record of matters being bought to Post Office FOI Teams attention that they "acting in good faith" (not advised by Andy Parsons surely)felt they didnt have to answer.

Yours sincerely,

john o'sullivan
