I am now writing to let you know the outcome of my internal review.

 

I am upholding the decision by colleagues in Cambridge Assessment
International Education to withhold the information that you requested. My
view is that our competitors could gain a competitive advantage if we
released exam entry data for specific qualifications in specific markets
as this would enable them to get a clear understanding of how we are
performing and  help them to devise their marketing and sales strategies
to improve their market position to our detriment. I am satisfied that
section 43(2) (which relates to commercial interests) of the Freedom of
Information Act applies to the information you have requested, therefore,
especially when you also take into account the fact that our main
international competitors are not subject to the Freedom of Information
Act and are, therefore, not obliged to release any data which could impact
their commercial positions.

 

Section 43 is a qualified exemption and we are, therefore, obliged to
consider the public interest test. It is not clear to me how the public
interest would be served by releasing this information and it’s also
important to highlight that the qualifications are not used currently in
state-maintained schools in Sri Lanka so I am not sure why there would be
a broader public interest in this information. Conversely by releasing the
information we could, as I have stated above, be undermining our own
competitive position which in the long run could mean less competition in
the market which is surely not in the wider public interest. I am
satisfied, therefore, that the public interest in withholding the
information outweighs the public interest in disclosing it.
