Please provide the following information to me in full answering honestly for the year 2000 to the present:

1. How many psychiatric assessments in care proceedings has Dr Susan E Bradbury completed from 2000 to the present, please provide the exact number of assessments she was instructed in?

2. Of what percentage of cases was Dr Bradbury instructed as an expert witness in care proceedings?

3. Of how many of those assessments were the parent(s) deemed to have a diagnosis of Borderline Personality Disorder, please give exact number not simply a percentage?

4. Of the above cases, in how many proceedings was Dr Bradbury called to be cross examined?

5. Of the above cases, in how many was contradictory psychological evidence provided?

6. Of the above cases how many parents did Dr Bradbury deem to have a mental health problem, which in her opinion was 'untreatable'??

7. How much have NYCC paid Dr Bradbury in total for her involvement on carrying out expert witness assessments?

Freedom of Information Request: Psychiatric Assessments in Care Proceedings

I am writing in connection with your Freedom of Information Act (FOIA) request dated 4 May 2012, in which you request responses to several questions asked by you relating to psychiatric assessments produced by Dr Bradbury in local authority care proceedings since the year 2000.

Section 32(1)(a) of the Act states that information held by a public authority is exempt information if it is held only by virtue of being contained in any document filed with, or otherwise placed in the custody of a court for the purpose of proceedings in a particular cause or matter. In addition, section 32(1)(b) states that information held by a public authority is exempt information if it is held only by being contained in any document served upon, or by, a public authority for the purpose of proceedings in a particular cause or matter.

It is the view of the authority that the information you request falls under the section 32 FOIA exemption, and therefore cannot be disclosed. As you are aware, Dr Bradbury has been instructed in numerous care proceedings over the years, jointly by the Local Authority and other parties as an expert witness, and has provided all of her reports on this basis - to be used within the proceedings. Such reports have been filed within the court proceedings and served on all parties of the proceedings, as is the usual process.

The County Council is therefore of the view that the information you request in response to your questions 1 - 6 is exempt information as set out in Section 32 of the Act and so will not be disclosed to you as a result of your request.

Whilst we are aware that you have made a similar request in the past which resulted in comparable information being disclosed to you without the Authority relying on the above exemption, there has been a recent decision of the First Tier Tribunal (Information Rights) on a very similar request. The County Council is minded to follow the advice provided by this decision with respect to the section 32 exemption. The Decision Notice is in relation to an appeal made against the Ministry of Justice, dated 26 March 2012, and can be found on the Information Commissioner's Officer website (www.ico.gov.uk) under reference FS50424760.

In response to your Question 7 - "How much have NYCC paid Dr Bradbury in total for her involvement in carrying out expert witness assessments?"; the County Council can confirm that the total amount, as recorded on our financial records is £6,820.20
