FREEDOM OF INFORMATION ACT REQUEST
Please accept our apologies for the delay in providing this response.
I refer to your Freedom of Information request in relation to Provision of
Statutory Maintenance - Passenger Lift Maintenance Winning Offer.
Right of Access
Section 1(1) of the Act provides any person making a request for
information to a public authority is entitled.
(a) to be informed in writing by the public authority whether it holds
information of the description specified in the request (which Section
1(6) of the Act designates as the "duty to confirm or deny"), and
(b) if that is the case, to have that information communicated to him.
The right is to obtain access to the information itself and not to the
document or record which contains it.
The Act creates a general right of access to information held by public
authorities subject to various exemptions.
Northumberland County Council confirms that it holds the information you
have requested, please see the following information in response.

The details we require are:
Q.1 LOT 9 a copy of the winning ITT
A.1 This information is exempt under Section 43 on the basis that it is
commercially sensitive. We would not give out a copy of a supplier's
successful submission as that is commercially sensitive information.
Q2 Suppliers who applied for inclusion on LOT 9 and were successful & not
successful at the PQQ & ITT stages
A.2 There was not a PQQ stage as this was an open tender process.
Successful supplier - Northern elevator.
Unsuccessful - Classic Lifts, Express Lifts, Orona Ltd, Rise Elevator, RJ
Lift Services, Pickering's Europe.
Q.3 Who is the senior officer (outside of procurement) responsible for
this contract?
A.3 Rebecca Bray, Statutory and Planned Maintenance Manager
Duty to confirm or deny
Northumberland County Council confirms that we holds certain information
relating to your request.
Exemptions
The Freedom of Information Act sets out various exemptions to the right of
access.
In the present case the County Council takes the view that the information
is exempt under section 43 on the basis that it is commercially sensitive.
In this case the Authority relies on section 43(2).
Freedom of Information Act 2000 Section 43(2): Information is exempt
information if its disclosure under this Act would, or would be likely to,
prejudice the commercial interests of any person (including the public
authority holding it).
Public Interest Test Considerations
Section 43 is a qualified exemption which means that the information
falling within the exemption still has to be released unless the public
interest in disclosure is outweighed by the public interest in maintaining
the exemption.
The reasons why the public interest favours withholding the information is
the successful tenderer Northern Elevator considers that all of the
information contained within their tender submission should be exempt from
disclosure under section 43 of the FOIA 2000 as they consider it to be
commercially sensitive and its disclosure would be prejudicial to their
commercial interests. The Council also considers that the release of this
information would be prejudicial to the commercial interests of the
Council in terms of its ability to access favourable terms in a
competitive market for facilities management services, which would not be
in the public interest.
