Provision of Alternative Provider of Medical Services (APMS) Contracts under six Lots across Thurrock and Southend

Dear NHS Mid and South Essex Integrated Care Board,

Given the prevailing uncertainty around the above contract award and to help alleviate suggestions of what seem to be a serious breach in the process, we kindly request the following evidence under the Freedom of Information Act to help ensure that the rules for public procurement and their guiding principles to safeguard fairness have been followed:

1. Why bidders who failed the mandatory pass/fail question were not excluded from the process?

2. Who is the actual contract holder – there seems to be conflicting information around this – is it Spirit Primary Care Ltd, Spirit Healthcare Ltd or someone else?

3. Evidence of the declarations of the multiple companies involved in running the awarded contract:

- Spirit Healthcare Ltd
- Spirit Primary Care Ltd
- Norse Medica
- Prenetics EMEA Ltd
- Oxsed

4. Were the authority aware within the bid proposal that the operating entity would not be that to whom it was awarded to? Please note that we have been told that “although the recent APMS tender process resulted in Spirit Healthcare emerging as the preferred supplier, Norse Medica will be operating the contracts, and Norse Medica is a subsidiary of Prenetics EMEA Ltd”.

5. Records of the evaluation process (including scores) to ensure fair and consistent evaluation across providers and to confirm that comprehensive notes were kept throughout the process.

6. Evidence that the scoring mechanism was not changed partway through the process to favour a certain bidder.

It is clear from the uncertainty and suggestions around the contract award that all of the above will pass the public interest test and with regards to your consultation regarding any confidentiality of the companies involved = we believe this should be open and swift, as nobody should have anything to hide, as transparency is key to the process.
