Please provide evidence of all applications and response decisions made and received under section 38 of the Commons act 2006 and also evidence of any additional planning applications made under other relevant acts, relating to the newly leased out moorings on Leyton Marsh.

If no such applications were made for approval by the relevant outside authorities, then please provide documentary evidence of the internal planning process followed that led to the decision to create private moorings on Leyton Marsh that impede access to the land, particularly documents which describe the legal justification for approving the plan to lease private moorings at that location.

I write in response to your Freedom of Information request in which you
asked for:

 

“evidence of all applications and response decisions made and received
under section 38 of the Commons Act 2006 and also evidence of any

The land referred to is not designated as common land and so an
application under section 38 of the Commons Act 2006 is not required. The
moorings referred to are not residential and so planning permission is not
required for this use. We have submitted a planning application for the
associated physical development, specifically installation of the mooring
posts and a proposed path constructed of hoggin (clay, sand and gravel in
equal parts), a copy of which can be found attached.

 

The decision to offer formal non-residential mooring agreements to those
moored along the stretch of river bank owned by Lee Valley Regional Park
Authority (LVRPA) alongside Leyton Marsh without the permission of LVRPA
was taken as a result of internal discussions between the parklands
management, marina management and the property team concerning
unauthorised moored vessels on the marshes, the resulting negative impact
on the immediate area / habitat and the impact on marina services and
amenities. This was an operational decision which did not require planning
applications and so no formal documentation relating to this exists.

 

I trust this now satisfies your request.  If you are dissatisfied with the
handling of your request, you have the right to ask for an internal
review. Internal review requests should be submitted within two months of
the date of receipt of the response to your original letter and should be
