Under the Freedom of Information Act I wish you to provide all details of communications between the Council and LGO in regard to the cases listed below:

Case: 14000398

These communications should be listed in a table chronologically tabulated, with date and communication In /Out noted and the author of the communication along with the case reference. With headings as above on each column

I would be grateful if under same the Freedom of Information Act you can supply the correspondence i.e. letters; Emails; Telephone Notes and Meetings notes as detailed in this table as attachment to this response you supply from LGO.

Dear Foi Officer,

I have not as you stated requested correspondence in relation to a casse file as you have indicated. I have asked for communications with Hastings Borough Council in reference to these cases. Please read my request properly

I have already noted to you I am not a member of the Public and I am the case Complainant on these cases which you have ignored.

Your points: “Such a restriction applies to the Ombudsman’s complaint files. Under the Local Government Act 1974 (section 32(2) or 34(K)(1)), the Ombudsman is not permitted to disclose any information obtained in the course of, or for the purposes of, the investigation of a complaint, unless she considers it is necessary for the purposes of the investigation (or for other very limited reasons mostly related to legal proceedings)." are not relative to the reason for my request as you have explained in correspondence my only recourse is through Judicial Review.

I am also surprised that you refer incorrectly in your statement to a 'her' I find this comment from you a case of sexism as there has been both male and females involved in these cases . A fact you should already be aware of. I caution you in repeating this comment in letter again and would strongly suggest you retract your current statement at your earliest convenience as this is quite unprofessional for a government Orgaisation.

If you are failing to return this information you should note your own correspondence and advice before making such claims to not provide information you hold. I am not thoroughly surprised as it is clear to me that your complaints procedure is not run correctly.

If you do not hold this information you should state this.

Your refusal of information also relates to an investigation which I and my organizations do not consider has been executed and therefore is not subject to your reasons of failure to supply this information.

I would also suggest that this current action could be considered as you trying to hide information from these poor investigations and would be frowned on in Court of Law and advice you caution in your responses.

Dear Foi Officer,

Thank you for your reply. I note you have made no appology for your sexist comments only a comment which seems to be unrelated as the person you have spoken about has never dealt with any of the cases or case numbers I gave you. The people involved are Ms. A Davidson, Mr. D Connolly, Mr. S Hazell, Mr. P Lewis ,Mr. K Nevols only I should not needed to have informed you of this.

With rgeard to my identity you could quite easily use email on the case email and obtain this personal information.

I have not written that you have told me my next recourse is only a Judicial review . This was sent to me by email seperatly.

If you would have looked at these case I refered you to to provide information I would have expected you to have known this todate you have not provided me with information to obtain this information. I have informed you I have tried to open complaints during these process and these complaints have not been dealt with through a complaint process which seems not to exist or be available in any normal terms of a complaint process with two or three levels of investigation. I have told you that I do not consider you have made a laweful decision on any of the cases. I suggest you obtain the files and looking to this fully with my Freedom of Information Request and provide the information I have requested.

As you have mentioned the cases It was quite clear from one of the cases that the Inspector failed to identify anything having not read the correspondence which was sent in. Then stating the matter was out of time before making a judgement which was ill formed and made no mention of maladministration . Despite letters to PACAh with this clearly identified.

You wrote that you have tead my request . It would apear you are still confussed as what is being said and by who . This is quite unprofessional.

The outcome of an LGO complaint is made publicly available (with personal details withheld) so there's no logical reason why the documents from case files are not disclosable under the Information Act – the complainant's personal data can be redacted.

Moreover, a subject access request (SAR) under the Data Protection Act is for obtaining personal information the organisation holds "about you" that you would not want anyone else to see. Documents from LGO case files contain information about a complaint, NOT personal information the organisation holds "about you" and can hardly be considered to fit the description of that for which submitting a SAR is necessary.

I would suggest if i need a review of this information I will ask for an internal Review and then place the matter berore the ICO and then via the First -tier Tribunal service will make requiest for these documents by expresion through Court Tribunal Service.
