Protocol for reporting criminal offences within council to Humberside police

Response to this request is long overdue. By law, under all circumstances, North East Lincolnshire Council should have responded by now (details). You can complain by requesting an internal review.

I would like details of any agreed protocol(s) for the reporting of criminal, or suspected criminal offences to Humberside police which have come to the attention of the relevant officer (presumably Monitoring officer) concerning any officer/member within North East Lincolnshire Council.

Thank you for your information request, reference number NELC/9616/1819. I
wish to confirm that North East Lincolnshire Council

holds the following information.

 

Request: I would like details of any agreed protocol(s) for the reporting
of criminal, or suspected criminal offences to Humberside police which
have come to the attention of the relevant officer (presumably Monitoring
officer) concerning any officer/member within North East Lincolnshire
Council.

 

Details would include the person/position nominated as the point of
contact for example (both council and police)

 

Response: The Constitution and the Whistleblowing Policy are the main
documents in so far as Officers and Members are concerned and they cover
issues of criminality, however there is no written protocol for the
reporting of any criminal or suspected criminal offences to Humberside
Police. This would be dealt with on a case by case basis, usually by the
Monitoring Officer.

 

The whistleblowing policy details instances when matters may be referred
to the Police or other agencies:

In addition The Constitution governs the conduct of officers and members
and details how matters will be addressed:

So far as the Council is concerned a point of contact would depend upon
where within the Council such an event arose or was alleged to have
arisen.  The Monitoring Officer is also likely to be involved.

 

The Council/Monitoring Officer has a point of contact with Humberside
Police at Detective Sergeant level.

 

If you believe that your request for information has not been handled in
accordance with the Freedom of Information Act, you have the right to
request an internal review by the Council. Please be clear about which
elements of the Council’s response or handling of the request you are
unhappy with, and would like the Council to address during the internal
review process.  If following this you are still dissatisfied you may

Dear PPD - FOI,

The following document (Appx 8 Protocol Humberside Police) suggests that Detective Sergeant Mike Wood of Humberside police's Economic Crime Unit was at the relevant time nominated the single point of contact regarding an agreed protocol for the reporting of potential criminal offences.

Did you ask for a revierw of this,

They havent answered you properly, The monitoring officers does have a legal requirment to report any fraud, not just to teh police.

These three roles in council have special conditions baked in

our monitoring officer has had evidence of frauds presented formaly to him and ignored it. plerasenesure you appleal this. Regards George
