Protocol for issuing planning decisions

We're waiting for Stuart May to read a recent response and update the status.

Dear Babergh District Council,

Has the Council consulted any applicant regarding the wording of a draft decision notice, and has the Council amended the wording thereof as a result of representations made?

If so, would you kindly give examples.

Furthermore, would you advise as to whether officers of the Council consulted David Wilson Homes (regarding the drafting of a refusal notice at the Fleetwood site at Long Melford), and if so, what was the original wording and what amendments were suggested by the applicants, and what changes were made by the Council as a result?

Yours faithfully,

Stuart May

Dear Babergh District Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Babergh District Council's handling of my FOI request 'Protocol for issuing planning decisions'.

My request is a matter of public interest and, whilst I do not wish to receive details of the issues under consideration, I believe that I am entitled to be provided with the quantum of current or impending cases. The release of this information would not prejudice the Council's case in any current or forthcoming hearing.

All that I require is the number of cases, NOT the details thereof.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/p...

Yours faithfully,

Stuart May

Dear Smith, Karen (Legal),

I note that you have mixed up my requests.

Your letter of 24 April 2014 refers to my request of February 2014, yet your reply related to a different, more recent request in respect of protocols for planning decisions.

Can you please clarify.

I confirm that I wish my request for an internal review in respect of my February request to proceed, and await your acknowledgment and response to my request regarding protocols for planning decisions and the Long Melford Fleetwood decision.

Yours sincerely,

Stuart May

Dear Mr May

My letter of 24th April was in response to your request asking about legal proceedings as it clearly stated. Your request about planning protocols was received on 24th April and is being logged at the present time. I cannot locate an earlier request relating to planning protocols and so am at a loss to understand your request of 24th April for an "internal review of Babergh District Council's handling of my FOI request "Protocol for issuing planning decisions"" received the same day. I would be grateful if you could provide me with the council's reference for the earlier request ( BF.... ) or a copy of the response so I can follow up on this.

Yours sincerely

Dear Smith, Karen (Legal),

Your letter of 8 May 22014 refers.

Your response states: "Your request about planning protocols was received on 24th April and is being logged at the present time".

Given that my request for information in respect of planning protocols i.e. liaising and discussing the content of decision notices with applicants prior to issuing notices, has been received by you and has probably been logged by now, I wonder whether you are now in a position to respond.

I understand that the Council should have responded within 20 days of my request.

Yours sincerely,

Stuart May
