Dear City of York Council,

Thank you for answering my first request on protected salaries. https://www.whatdotheyknow.com/request/p...

1. Now it is clear that this local agreement is available to all staff please confirm if the decision to award protected salary status is agreed by Members or if, like NDAs to date, top staff did this unsupervised.? Just like NDAs, I have not seen any reports entitled protected salaries reported to staffing.

Please also answer the following for every year since the policy was instituted.

2. By Grade, By Department how many staff each year were put on these protected salaries.

3. Regarding the salary of the to be demoted s151 Officer please post the actual calculation used by HR and his base line-assuming that he is demoted this fiscal year for the duration of the special treatment.

Thank you

Yours faithfully,

Gwen Swinburn

Dear Ms Swinburn

Please see below the response to your enquiry for points 1 and 3 under the
Freedom of Information Act received on 30 August 2019.

Thank you for answering my first request on protected salaries.
[1]https://www.whatdotheyknow.com/request/p...

1. Now it is clear that this local agreement is available to all staff
please confirm if the decision to award protected salary status is agreed
by Members or if, like NDAs to date, top staff did this unsupervised.?
Just like NDAs, I have not seen any reports entitled protected salaries
reported to staffing.

The application of the Pay Protection Policy is the responsibility of
Officers and does not require member approval.  You have previously been
provided with the Pay Protection document and are therefore aware of the
principles behind applying Pay Protection. Pay protection is applied to
staff who have been through a management restructure following
consultation and involvement of the Trade Unions.  Redeployment of staff
into alterative roles is requirement of the Council to mitigate redundancy
where applicable.

Please also answer the following for every year since the policy was
instituted.

2. By Grade, By Department how many staff each year were put on these
protected salaries.

The service area are currently still working on interrogating systems in
order to retrieve all the relevant information for this part of your
request.  Due to the manual work involved in this, we are not able to
include the relevant information at this time but will send this by no
later than Friday 11^th October 2019.

3. Regarding the  salary of the to be demoted s151 Officer please post the
actual calculation used by HR and his base line-assuming that he is
demoted this fiscal year for the duration of the special treatment.

It is considered this information will disclose the personal details of an
individual, where it is not considered there would be any lawful basis for
this.

If you are dissatisfied with our response you have the right to ask for a
review of how your enquiry was handled and responded to. This can be done
by contacting us through [2][City of York Council request email] stating your reason(s) why you
are dissatisfied. If you remain dissatisfied after receiving the review
response you
