Prosecutions of ‘rogue landlords’ between January 2015 and July 2022

We're waiting for Oliver Murphy to read recent responses and update the status.

Dear FOI Team,

I write under the terms of the Freedom of Information Act to request data relating to the number of ‘rogue landlords’ successful prosecuted between January 2015 and July 2022.

In the context of this request, the term ‘rogue landlord’ is defined as a landlord who ‘knowingly flouts their obligations by renting our unsafe and substandard accommodation to tenants, many of whom may be vulnerable.'

As part of this, I would like the information broken down into the following:

i) The number of rogue landlords not complying with safety regulations identified by this authority between January 2016 and July 2022;

ii) Of this amount, the number of rogue landlords not complying with safety regulations that were successfully prosecuted during the requested time frame;

iii) Of the total amount, the number of rogue landlords not complying with safety regulations that were unsuccessfully prosecuted during the requested time frame;

iv) Of the total amount, how many rogue landlords not complying with safety regulations that have been punished via other means, e.g. fines.

Dear Oliver Murphy,

Freedom of Information Request - Case Ref/ BDC00408

I am writing in response to your request for information which was
received on the 26/09/2022 and has been dealt with under the Freedom of
Information Act 2000 (“the Act”).

The information you requested is enclosed.

i) The number of rogue landlords not complying with safety regulations
identified by this authority between January 2016 and July 2022;

We are not able to answer this question as it is too subjective. We could
give a figure for the number of complaints received about housing
conditions but this will not record whether each complaint meant that
regulations were being breached (Part 1 of the Housing Act 2004 is a risk
assessment tool rather than a list of requirements), and whether a
landlord "knowingly flouts their obligations" is a subjective judgement
unless a Court finds that they have.

ii) Of this amount, the number of rogue landlords not complying with
safety regulations that were successfully prosecuted during the requested
time frame;

Two landlords have been successfully prosecuted for failure to comply with
HMO Management Regulations in relation to housing safety matters in the
time period specified. One landlord has been successfully prosecuted under
HMO licensing Regulations which are not necessarily all related to safety
matters.

iii) Of the total amount, the number of rogue landlords not complying with
safety regulations that were unsuccessfully prosecuted during the
requested time frame;

There have been no unsuccessful prosecutions relating to housing safety in
the time period specified.
