Dear School Transport Policy Group,

I can confirm that the information requested is held by Leicestershire County Council.

On identifying the information requested it has become necessary to apply a public interest test. This is where the Council needs to balance the public interest in disclosing the information against the public interest in withholding it. The Council's Public Interest Panel is to consider your request.

The Freedom of Information Act obliges us to respond to requests promptly, and in any case no later than 20 working days after receiving your request. However when a qualified exemption applies to the information and the public interest test is engaged, the Act allows the time for response to be longer than 20 working days, and a full response must be provided within such time as is reasonable in all circumstances of the case.

In your case we estimate that it will take additional 20 days to take a decision on where the balance of the public interest lies. Therefore, we plan to let you have a response by 8th May 2014. If it appears that it will take longer than this to reach a conclusion we will keep you informed.

The specific exemptions which may apply to your request are:
Section 36 - Prejudice to the Effective Conduct of Public Affairs
Section 42 - Legal Professional Privilege

As explained in my previous email, it has become clear that it is necessary to apply a public interest test before releasing the information.

In accordance with the Freedom of Information Act 2000 this letter acts as a Partial Public Interest Refusal Notice.

The exemption applied is Section (2) 42 Legal Professional Privilege.

The redacted (blacked out) information contained within the document accessible via the link above is subject to the aforementioned exemption under the Freedom of Information Act 2000.

Legal Professional Privilege is a qualified exemption and therefore requires the Council to undertake a Public Interest Test.

In undertaking this test we must balance both the public interest in disclosing the information against the public interest in maintaining the confidentiality of the information.

In this instance the disclosure relates to legally privileged information and the exemption applies in this instance as it covers confidential communications between a client and lawyer, made for the main purpose of seeking or giving legal advice.

This information has not been subject to any wider disclosure outside the Authority and has the necessary qualities of being given as legal advice.

Although the Council accepts that there is a strong public interest in knowing and understanding the issues that affect Council decisions, this right has to be balanced against the ability of the Council to seek legal advice and guidance, without prejudice, to ensure that it makes lawful decisions.

Therefore in this instance the Council believes that the public interest lies in maintaining this exemption.
