Dear Mark Unsworth
Thank you for your email of 30 June 2014 where you requested information
about properties owned, by conservative MP, Richard Benyan.
I can confirm that the Land Registry holds this information.
Under section 21 of the Freedom of Information Act (the Act), we are not
required to provide information in response to a request if it is already
reasonably accessible. The information is available under the LRA 2002 and
LRR 2003. Please see Public Guide 1 (A guide to information we hold and
how you can obtain it) from our web site
[1]http://www.landregistry.gov.uk/public/gu...
S.16 of the Act carries a duty to provide advice and assistance. Land
Registry holds an index of ownership. The index is called the Index of
Proprietors’ Names (IOPN) and is held under the provisions of rules 11 and
140 of the Land Registration Rules 2003 (LRR 2003). Access to the index is
not automatically available but there is provision for the registrar to
exercise discretion and allow a search. The index contains proprietorship
details relating to over 23 million registered titles.
The registrar will only exercise his discretion under rule 11 LRR 2003 in
limited circumstances to allow a search of the index against a private
individual. These include applications made:
by the person themselves;
on behalf of the named person and their authority accompanies the
application;
by the personal representative of the named person;
by the trustee in bankruptcy of the named person; or
on the basis of a Court Order expressly authorising a search of the Index
of Proprietors’ Names and specifying the name to be searched and any
variations.
Please note that any information in the index relating to a private
individual would be regarded by Land Registry as personal data and is,
therefore, exempt from disclosure by virtue of section 40 of the Freedom
of Information Act 2000.
We permit searches of the index against all non-private individuals, for
example, companies, banks, building societies, local authorities and
Government departments.
If you would like to make a search you can apply for a search of the index
using form PN1 for each name to be searched and a fee of £11 per name is
payable under the current Fee Order for each name. If a search finds a
match to a name searched, a list of title numbers will be generated. You
will then have to undertake a search against each title to check which
properties are owned by those companies and which will provide details you
are seeking. Copies of form PN1 can be obtained free of charge from any
Land Registry Office or from our website [2]www.landregistry.gov.uk . I
would refer you to our Practice Guide 74 “Searches of the Index of
Proprietors’ Names (in particular sections 3 and 4) which is available
from our web site
[3]http://www.landregistry.gov.uk/professio...
This guide provides information concerning the IOPN and the circumstances
in which a search may be carried out and how such an application can be
made.
Again I would emphasise that personal data is exempt from the Freedom of
Information Act.
If you have any queries about this letter, please contact me.
If you are dissatisfied with this response to your request, you may seek
an internal review within two months of the date of our reply. Internal
reviews will be dealt within 20 working days. If at the end of this time
we are unable to respond, we will write to you explaining the reasons and
giving you a new date. If you seek an internal review please write to:
Mike Westcott Rudd

If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner (ICO) within
two months of the reply for a decision. Generally, the ICO cannot make a
decision unless you have exhausted the complaints procedure provided by
Land Registry. The Information Commissioner can be contacted at: The
Information Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow,
Cheshire SK9 5AF.
