FOI, Northern Ireland Transport Holding Company

Dear Sir/Madam,

Thank you for your Freedom of Information request (our ref FOI901) which
was received on 9 February 2020.

Your request, was as follows:

I would like to know the full dispatch procedures (eg. with baton, ra
signal etc).

Response

As required by section 1(1)(a) Freedom of Information Act (the “Act”), we
can confirm that we do hold the various pieces of information specified in
your request.

However, we consider that the requested information is exempt from release
under section 38 of the Act. This exemption applies where disclosure of
the information would be likely to endanger the safety of any individual.

Disclosures made under the Act are deemed to be a ‘disclosure to the world
at large’ and whilst we make no suggestion that you would use this
information for anything other than your own personal interests, it could
be used by individuals who wish to cause harm or disruption to our
customers, staff and network. There is the potential for our dispatch
procedures to be replicated by a member of the public and therefore we
would regard this as unsafe practice. The public interest in protecting
individuals and infrastructure is very high and our upmost priority. We
recognise that there are individual and personal interests in
understanding the workings of our network, but these clearly do not
outweigh that wider public interest relating to safety.

Review Procedure

We trust this answers your request, however, if you are not satisfied with
this response you may request a review by writing to the Translink General
Counsel and Company Secretary, who has overall responsibility for Freedom
of Information and Data Protection issues within this organisation.
Correspondence should be addressed to the above-mentioned at: Translink,
22 Great Victoria Street, Belfast BT2 7LX or by email to
[1][NITHCo / Translink request email].

If having exhausted the review process you are not content that your
request or review has been dealt with correctly, you have a further right
of appeal to the Information Commissioner who will make an independent
judgement. The address of the Information Commissioner is: Wycliffe House,
Water Lane, Wilmslow, Cheshire, SK9 5AF. The address of the Information
Commissioner’s Office for Northern Ireland is: 3rd floor, 14 Cromac Place,
Gasworks, Belfast, BT7 2JB.

Kind Regards,

The FOI/DPA Team

Dear Northern Ireland Transport Holding Company,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Northern Ireland Transport Holding Company's handling of my FOI request 'Proper Train Dispatch Procedure'.

As an enthusiast, If possible, could you please arrange a demonstration of one of your staff members dispatching a train?

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/p...

Yours faithfully,

C. Graham

Richard Knox, Northern Ireland Transport Holding Company

Good morning Mr Graham,

Although an unusual request, we are happy to facilitate a demonstration on
train dispatch however, Covid 19 restrictions prevents us from doing so at
present as we are only running training and assessments as and when
required.

I will keep your details on file and contact you as soon as it is safe for
us to honour your request.

Regards

Richard Knox

Dear Mr Graham,

Thank you for your email of 13 July 2020. As your request below does not contain a request for recorded information, we have deemed this a regular line of business query. I have passed this on to Richard Knox, from Translink's rail division, who from my understanding has contacted you regarding your query.

Kind regards,
