6. Details of the amounts of *statutory interest and statutory compensation paid during the financial year?
7. Value of amounts of *statutory interest and statutory compensation payable if all suppliers exercised their automatic entitlements to both

Dear Ministry of Justice,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Ministry of Justice's handling of my FOI request 'Prompt and Late Payment of Invoices'.

In responding to my request the Ministry of Justice has chosen to avoid disclosure by seeking to shelter behind a Freedom of information exemption [Section 12 (1)]. The use of this exemption is an unreasonable abuse of the legislation particularly since some of the information requested should have already been available and published on the Departments website.

By the handling of my request the Department seems to be acknowledging it is unaware and has failed to comply with the disclosure regulations as set out in the Public Contracts Regulations 2015 – Regulation 113.

The following extract from Crown Commercial Services Guidance Note PPN 03/16 may be helpful in enhancing you understanding, namely:
Point 6. After March 2017, all in-scope organisations must publish, on an annual basis and covering the previous 12 months, (i) the percentage of their invoices paid within 30 days ii) the amount of interest paid to suppliers due to late payment and iii) the total amount of interest that the contracting authority was liable to pay (whether or not paid and whether under any statutory or other requirement), due to a breach of Regulation 113.

Assuming that, with a better appreciation of the reporting requirements of Regulation 113, it will be accepted that the Departments initial response was incorrect and to avoid further attempts to utilise cost as a reason for non-disclosure I have revised my original information requests:

For the year 2016-17 please confirm:
1) Percentage (%) of suppliers invoices paid within 30 calendar days?
2) Number of suppliers invoices paid later than 30days (i.e. late)?
3) Details of the amounts of *statutory interest claimed and paid to suppliers?
4) the total amount of interest that the Ministry of Justice was liable to pay (whether or not paid and whether under any statutory or other requirement), due to a breach of Regulation 113.
