Freedom of Information Request – Response
Section 1 of the Freedom of Information Act 2000 provides two distinct but
related rights of access to information which impose corresponding duties
on public authorities. These are:
o The duty to inform the applicant whether or not information is held by
the authority and, if so,
o The duty to communicate that information to the applicant.
Thank you for your request received on 10 September 2019 for the following
information:
Which projects, in which wards, at what locations and at what costs
have been funded by Section 106 funds from 2010 to 2019?
Your request has been considered. Please find below response relating to
your request.
S106 agreements relate to each development. They must be:
o necessary to make the development acceptable in planning terms;
o directly related to the development; and
o fairly and reasonably related in scale and kind to the development.
These tests are set out as statutory tests in [1]regulation 122 (as
amended by the 2011 and 2019 Regulations) and as policy tests in the
National Planning Policy Framework. These tests apply whether or not there
is a levy charging schedule for the area.
Therefore, all S106 agreements will relate to the site/surrounding area
(in most circumstances). These agreements and the associated wording for
contributions can be found on the Council’s planning website for the
appropriate documents.
