Prohibition Notices

The request was refused by Scottish Fire and Rescue Service.

Dear Scottish Fire and Rescue Service,

I’d like to know since 14th June 2017, how many many multi-occupancy residential buildings in your authority have been served prohibition notices by the FRS or Council due to Fire Safety concerns, with residents forced to leave?

If possible, please include as much of the following in the disclosure relating to each incident
- The date of the order
- The address of the property
- The reasons given
- The number of individual units / homes affected (if they can provide that)

Thank you for your request for information and apologies for the delay.  

 

Your request has been processed in accordance with Freedom of Information
(Scotland) Act 2002.

 

I refer to your request and can advise that the Scottish Fire and Rescue
Service has 356 fire stations covering all of Scotland covering hundreds
of thousands of premises both domestic and non-domestic (domestic premises
are not relevant under the Fire Scotland Act 2005).

 

Your request has been considered, however we are unable to comply with
your request.  The broad nature of the request would require a
considerable amount of time and effort to comply with and the cost of
doing so is estimated to an amount more than the appropriate limit
prescribed within the fees limit allowed in the Freedom of Information
(Fees for Required Disclosure) (Scotland) Regulations 2004 and the Freedom
of Information (Fees for Disclosure under Section 13) (Scotland)
Regulations 2004.  The amount prescribed for the purposes of section 12(1)
of the Act (excessive cost of compliance) is £600.

 

The SFRS does not hold information of any notices issued by a council
therefore Section 17(1)(b) of Freedom of Information (Scotland) Act 2002,
notice that information not held is applicable.

 

Should you not be satisfied with the outcome of our response and review,
you have the right to appeal to the Scottish Information Commissioner
within 6 months.  The Commissioner will decide whether your request has
been dealt with properly, in accordance with the Act.
