Procurement of vaccines
Dear NHS England,
In 1990 you procured pertussis vaccines for the use of MOD from Wellcome (now GSK) & MeriuxUK.
My question is were there any immunity agreements put in place between these companies & NHS . Also was there any immunity agreements in place between NHS & MOD? Did NHS Protect itself from claims from the damage caused?
Thanks,
Regards,
Gavin Roberts,

Dear Gavin Roberts,
Thank you for your communication dated 11 September 2023,
NHS England has assessed your communication as a request under the Freedom
of Information (FOI) Act 2000. As such, your request is being dealt with
under the terms of the FOI Act, and has been allocated the following
reference number: FOI-2309-2021424.
Your exact request was:
“Did NHS protect itself from Lawsuits from Gulf War Veterans 1991
following supplying MOD with pertussis for Gulf War Trooos in full
knowledge it was not licensed safe to do so?”
NHS England does not hold information in relation to your request.
It may help if we first explain that NHS England is not the same as ‘the
NHS in England’. The NHS in England is not a single organisation but is
made up of a range of organisations such as Hospitals and Integrated Care
Boards (ICBs). Therefore, any recorded information NHS England may be able
to provide in response to an FOI request will generally relate to the
services NHS England commissions.
On this occasion NHS England is unable to confirm who would hold the
requested information.
We hope this information is helpful. However, if you are dissatisfied, you
have the right to ask for an internal review. This should be requested in
writing within two months of the date of this letter. Your correspondence
should be labelled “Internal Review” and should outline your concerns
and/or the area(s) you would like the review to consider. Internal Review
requests should be sent to:

decision. The Information Commissioner’s Office (ICO) can be contacted
[2]via their website.
Please note there is no charge for making an appeal.
