In reply to your email, received on 15th June 2010, Highlands and Islands
Enterprise (HIE) has responded to your questions below.

1) How do you procure construction consultancy services?

Since 2004 HIE has procured Construction Consultancy Services through a
series of Framework Contracts. These contracts have been procured
through an open competitive OJEU procurement process, and are openly
advertised on the websites
for "Public Contracts Scotland" [1]www.publiccontractsscotland.gov.uk, the
European Journal, "Tenders Electronic Daily"
[2]http://ted.europa.eu/TED/main/HomePage.do and the HIE
website [3]http://www.hie.co.uk/tenders.htm. These frameworks allow HIE
to undertake various parcels of consultancy work without the need to
procure the consultancy services on a project by project basis.

Ad hoc construction consultancy services, when required due to their
nature and specialism are either procured via a competitive tender basis
by asking several firms to tender for the works, or via one of the
pre-tendered OGC/Buying Solutions style frameworks. To date HIE has
used two Buying Solutions Framework contracts for Design Services and
Project Management Services contracts on the new Inverness Campus
project.

2) How do you procure construction contractors?

Since 2004 HIE has procured Construction Contractors through a Framework
Contract. The contract allows HIE to award both design and building
contracts to their contractor without the need to procure projects
independently through competitive tender or OJEU processes.

3) If by your own framework, please tell me:

a) The titles and content of the relevant frameworks

Construction Consultancy Contract - "Prime Consultant" - Currently held by
Torrance Partnership since January 2009 with contract expiry in January
2012

Construction Contractors - "Prime Contractor" - Currently held by Rok
Building Limited, although currently being re-tendered, with new contract
due to be awarded in July 2010 for 4 years

b) Who is on the current frameworks

c) The start and end dates of the frameworks

d) Any possible extension periods to the frameworks

Both the Prime Contractor and Prime Consultant contracts are awarded as a
3 year contract with one year possible extension based on performance.
