Procession Notice for Preston New Road at Cuadrilla development site

Part 11 Processions and Assemblies

In regards to:

Preston New Road, A583, Cuadrilla Site Entrance Development for Shale Gas Site

For the period commencing January 2017...:

11. Advance notice of public processions.
(1) Written notice shall be given in accordance with this section of any proposal to hold a public procession intended-
(a) to demonstrate support for or opposition to the views or actions of any person or body of persons......,

unless it is not reasonably practicable to give any advance notice of the procession.

(3) The notice must specify the date when it is intended to hold the procession, the time when it is intended to start it, its proposed route, and the name and address of the person (or of one of the persons) proposing to organise it.

(7) Where a public procession is held, the time when it is held, each of the persons organising it is guilty of an offence if-.....

Please can I be provided with the written notice requesting "Advance Notice" permitting the 15 minute "slow walks" of all lorries entering the Cuadrilla development site commencing January January 2017.

I have witnessed the police issuing S.12.1 warnings of arrest to demonstrators on 16/01/17 citing they were facilitating peaceful demonstration by allowing 15 minute slow walks at the Cuadrilla development site within the agreed procession agreement. The police will have a good record of this incident at between 09.38 and 10.18. The warnings of breaching the was delivered by KA10.

Therefore as well as the "Advance Notice" please can I be supplied with any other written emails, letters or legal agreements between Lancashire Police the organisers who applied for the "Advance Notice" and all other interested parties to include Cuadrilla group of associated companies.

Finally, if the 15 minute "slow walks" are being undertaken just by a verbal agreement please confirm all parties that agreed to a verbal agreement and how this complies with the requirements of Part II (1) of the 1986 Act requiring advance notice of processions.

I am writing to request an internal review of Lancashire Constabulary's handling of my FOI request 'Procession Notice for Preston New Road at Cuadrilla development site'.

1. I have received no explanation of the reason for the delay in responding to this request.
2. The response is unacceptable and unlawful. I know for a fact that Lancashire Constabulary does hold much more information that falls within the scope of my request.
3. I therefore consider that the response to my request constitutes an offence under Section 77 of the Act
